       AN ACT to amend the state finance law, in relation to  providing  grants
         to rebuild storefronts damaged by Hurricane Sandy
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Definitions. For the purposes of this  act,  the  following
    2  terms shall have the following meanings:
    3    1. "Severely damaged storefront" shall mean a storefront of a property
    4  which  was  damaged  as  a  result  of  Hurricane Sandy and the costs of
    5  repairs to rebuild such storefront total ten thousand dollars or more.
    6    2. "Hurricane Sandy" shall mean the storms,  rains,  or  floods  which
    7  occurred  during  the  period  beginning  on October 29, 2012 and ending
    8  November 3, 2012.
    9    3. "Small business" shall mean any business which  is  located  within
   10  this state, independently owned and operated, and employs fifty or fewer
   11  individuals.
   12    S 2. Storefront repair program. 1. Notwithstanding any other provision
   13  of  law,  an  owner  of  a  small business who, as a result of Hurricane
   14  Sandy, sustained a severely damaged storefront shall be eligible  for  a
   15  grant  of  ten thousand dollars to repair, rehabilitate, or replace such
   16  storefront.
   17    2. Application by a small business  owner  for  a  grant  pursuant  to
   18  subdivision  one  of this section shall be made to the division of home-
   19  land security and emergency services in a manner and form to  be  deter-
   20  mined  by  such  division.  Such  application  shall include, but not be
   21  limited to:
   22    a. proof that the business operated by the owner is a small business;

    1    b. proof that the business was operated prior to Hurricane Sandy;
    2    c.  proof  that  the  damage sustained to the storefront was caused by
    3  Hurricane Sandy;
    4    d. proof that the storefront is a severely damaged storefront; and
    5    e. any other information that such division deems relevant.
    6    3. Application for a grant authorized by this act shall be made on  or
    7  before July 1, 2015.
    8    S  3. The state finance law is amended by adding a new section 99-v to
    9  read as follows:
   10    S 99-V. HURRICANE SANDY STOREFRONT REPAIR FUND.  1.  THERE  IS  HEREBY
   11  ESTABLISHED IN THE JOINT CUSTODY OF THE COMPTROLLER AND THE COMMISSIONER
   12  OF  TAXATION  AND  FINANCE  A SPECIAL FUND TO BE KNOWN AS THE "HURRICANE
   13  SANDY STOREFRONT REPAIR FUND".
   14    2. THE SOURCE OF FUNDS SHALL CONSIST OF ALL MONEYS COLLECTED THEREFOR,
   15  OR MONEYS CREDITED, APPROPRIATED OR TRANSFERRED THERETO FROM  ANY  OTHER
   16  FUND  OR  SOURCE PURSUANT TO LAW, OR ANY OTHER MONEYS MADE AVAILABLE FOR
   17  THE PURPOSES OF THE FUND. ANY INTEREST RECEIVED BY  THE  COMPTROLLER  ON
   18  MONEYS  ON  DEPOSIT  SHALL BE RETAINED IN AND BECOME A PART OF THE FUND,
   19  UNLESS OTHERWISE DIRECTED BY LAW.
   20    3. FOLLOWING APPROPRIATION BY THE  LEGISLATURE,  MONEYS  IN  THE  FUND
   21  SHALL  BE  AVAILABLE FOR GRANTS AUTHORIZED BY THE CHAPTER OF THE LAWS OF
   22  TWO THOUSAND THIRTEEN WHICH ADDED THIS SECTION TO REPAIR,  REHABILITATE,
   23  OR REPLACE ELIGIBLE STOREFRONTS DAMAGED BY HURRICANE SANDY.
   24    4.  THE  MONEYS OF THE FUND SHALL BE PAID OUT ON THE AUDIT AND WARRANT
   25  OF THE COMPTROLLER ON VOUCHERS CERTIFIED OR APPROVED BY THE DIVISION  OF
   26  HOMELAND SECURITY AND EMERGENCY SERVICES.
   27    S 4. This act shall take effect immediately.
