        AN ACT to amend the state finance law and the tax law,  in  relation  to
          establishing the police officer protection fund
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The  commissioner  of  the  division  of  criminal  justice
     2  services  shall establish and implement a program to retrofit all patrol
     3  vehicles of the New York police department, and  thereafter  all  patrol
     4  vehicles  of  the  New York state police, with bullet-proof glass within
     5  five years of the effective date of this act. Funding for  such  program
     6  shall  be  drawn  from  the  police  officer protection fund established
     7  pursuant to section 99-ff of the state finance law.
     8    § 2. The state finance law is amended by adding a new section 99-ff to
     9  read as follows:
    10    § 99-ff. Police officer protection fund. 1. A special fund to be known
    11  as the "police officer protection fund" is  hereby  established  in  the
    12  custody  of  the  state comptroller and the commissioner of taxation and
    13  finance.
    14    2. The fund shall consist of  all  monies  transferred  to  such  fund
    15  pursuant  to law, all monies required by any provision of law to be paid
    16  into or credited to the fund, all monies from gifts pursuant to  section
    17  six  hundred thirty-g of the tax law and any interest earnings which may
    18  accrue from the investment of monies  in  the  fund.  Nothing  contained
    19  herein  shall prevent the state from receiving grants, gifts or bequests
    20  for the purposes of the fund as defined in this section  and  depositing
    21  them into the fund according to law.
    22    3. Monies of the fund, when allocated, shall be available to the divi-
    23  sion  of  criminal  justice services for the purpose of establishing and
    24  implementing a program to retrofit all patrol vehicles of the  New  York

     1  police  department,  and  thereafter all patrol vehicles of the New York
     2  state police, with bullet-proof glass.
     3    4.  Monies  shall be payable from the fund on the audit and warrant of
     4  the comptroller on vouchers approved and certified by  the  commissioner
     5  of criminal justice services.
     6    §  3.  The tax law is amended by adding a new section 630-g to read as
     7  follows:
     8    § 630-g. Gift for the police officer protection  fund.  Effective  for
     9  any  tax year commencing on or after January first, two thousand twenty,
    10  an individual in any taxable year may elect to contribute to the  police
    11  officer  protection fund. Such contribution shall be in any whole dollar
    12  amount and shall not reduce the amount of state tax owed by  such  indi-
    13  vidual.  The commissioner shall include space on the personal income tax
    14  return to enable a taxpayer to make such contribution.   Notwithstanding
    15  any  other  provision  of  law  all  revenues collected pursuant to this
    16  section shall be credited to police officer  protection  fund  and  used
    17  only  for  those  purposes  enumerated  in section ninety-nine-ff of the
    18  state finance law.
    19    § 4. This act shall take effect immediately.
