ROSENTHAL, COLTON, OTIS, ABINANTI, MOSLEY -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to prohibiting the use of Methoprene The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 33-1301 of the environmental conservation law is 2 amended by adding a new subdivision 12 to read as follows: 3 12. For any person to use any pesticide containing the active ingredi- 4 ent isopropyl(2E, 4E)-11 Methoxy-3, 7, 11 Trimethyl-2, 4 Dodecadienoate 5 (Methoprene) in any storm drain, conveyance for water or fish habitat in 6 any municipality adjoining the Long Island Sound and the Atlantic Ocean, 7 and their connecting water bodies, bays, harbors, shallows and marshes 8 provided, however, an emergency application of such pesticide may be 9 made as determined by the county health department in cases where there 10 is a significant threat to public health. 11 § 2.
