STATE OF NEW YORK ________________________________________________________________________ 6569 2019-2020 Regular Sessions IN ASSEMBLY March 12, 2019 ___________ Introduced by M. of A. FAHY -- read once and referred to the Committee on Children and Families AN ACT to amend the social services law, in relation to internet mapping resources of school age child care providers, afterschool and home visiting programs; and to amend the public health law, in relation to provision of information to the council on children and families The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 483-h of the social services law, as amended by 2 chapter 34 of the laws of 2018, is amended to read as follows: 3 § 483-h. Internet mapping resource of school age child care providers 4 [and], afterschool and home visiting programs. 1. The council, in 5 accordance with information made available to it by the office of chil- 6 dren and family services pursuant to section seventeen of this chapter 7 [and]; and information provided to [it] the council by the state educa- 8 tion department pursuant to section three hundred five of the education 9 law[,]; and information provided by the department of health pursuant to 10 section two hundred one of the public health law, shall develop and make 11 available through a link on its website an internet mapping resource of: 12 (a) all recipients of competitive grants awarded or administered by 13 the state office of children and family services or the state education 14 department for the purpose of providing: afterschool programs or 15 extended learning time, including but not limited to grants for such 16 purposes awarded under section thirty-six hundred forty-one of the 17 education law; and 18 (b) all registered school age child care providers registered by the 19 office of children and family services except for those who in accord- 20 ance with [paragraph] subdivision eight-a of section three hundred nine- 21 ty of this chapter have opted out of providing information online[.]; 22 and EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD10366-01-9A. 6569 2 1 (c) all home visiting programs that meet the criteria as required by 2 section four hundred twenty-nine of this chapter regardless of whether 3 they have a contract with or receive funding from the state, which 4 provide the necessary information to the office of children and family 5 services required pursuant to subdivision (i) of section seventeen of 6 this chapter, or the department of health as required by paragraph (w) 7 of subdivision one of section two hundred one of the public health law. 8 2. The internet mapping resource shall include the following informa- 9 tion for each grant recipient [or], provider or program: 10 (a) the recipient's [or], provider's or program's name[,]; 11 (b) the address at which the recipient, provider or program is offered 12 except for those who in accordance with [paragraph] subdivision eight-a 13 of section three hundred ninety of this chapter have opted out of 14 providing information online[, and]; 15 (c) the phone number for the recipient, provider or program[.]; and 16 (d) a general description of eligible individuals and families served 17 by the particular recipient, provider or program. 18 3. The internet mapping resource described in subdivision one of this 19 section shall be updated no less than once a year. 20 4. The council may include locations and information for additional 21 relevant programs as it sees fit. 22 § 2. Subdivision (i) of section 17 of the social services law, as 23 amended by chapter 34 of the laws of 2018, is amended to read as 24 follows: 25 (i) make available to the council on children and families information 26 regarding: (1) all recipients of grants awarded or administered by the 27 office of children and family services for the purposes of providing 28 afterschool programs; [and] (2) registered school age child care provid- 29 ers registered by the office of children and family services[. For each30grant recipient or provider the recipient's or provider's name, and the31address at which the program is offered except for those who in accord-32ance with paragraph eight-a of section three hundred ninety of this33chapter have opted out of providing information online, and the phone34number for the program will]; and (3) home visiting programs that meet 35 the criteria as required by section four hundred twenty-nine of this 36 chapter regardless of whether they have a contract with or receive fund- 37 ing from the state. Such information shall be provided in accordance 38 with the requirements set forth in subdivision two of section four 39 hundred eighty-three-h of this chapter. Such information shall be made 40 available no less than once a year; and 41 § 3. Subdivision (i) of section 17 of the social services law, as 42 relettered by section 1 of part K-3 of chapter 57 of the laws of 2007, 43 is relettered subdivision (j). 44 § 4. Section 429 of the social services law is amended by adding a new 45 subdivision 8 to read as follows: 46 8. Any home visiting program that meets the criteria delineated in 47 this section as determined by factors set by the office of children and 48 family services and the department of health, regardless of whether such 49 program contracts with or receives funding from the state, may provide 50 the necessary information to such offices as is required by subdivision 51 (i) of section seventeen of this chapter or paragraph (w) of subdivision 52 one of section two hundred one of the public health law in order for 53 their program to be made available on the internet mapping resource 54 maintained by the council on children and families pursuant to section 55 four hundred eighty-three-h of this chapter.A. 6569 3 1 § 5. Subdivision 1 of section 201 of the public health law is amended 2 by adding a new paragraph (w) to read as follows: 3 (w) make available to the council on children and families informa- 4 tion, in a format identified by the council, regarding home visiting 5 programs that meet the criteria as required by section four hundred 6 twenty-nine of the social services law regardless of whether such 7 program has a contract with or receive funding from the state. Such 8 information shall be provided in accordance with the requirements set 9 forth in subdivision two of section four hundred eighty-three-h of the 10 social services law. Such information shall be made available no less 11 than once a year. 12 § 6. This act shall take effect on the one hundred twentieth day after 13 it shall have become a law; provided, however that section three of this 14 act shall take effect upon the repeal of section 1 of part W of chapter 15 54 of the laws of 2016. Effective immediately, the addition, amendment 16 and/or repeal of any rule or regulation necessary for the implementation 17 of this act on its effective date are authorized to be made and 18 completed on or before such effective date.
