        AN ACT to amend the social services law, in relation to exempting income
          earned by persons under the age of twenty-five from certain  workforce
          development programs from the determination of need for public assist-
          ance programs
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subparagraphs (vii) and (viii) of paragraph (a) of subdivi-
     2  sion 8 of section 131-a of  the  social  services  law,  as  amended  by
     3  section 12 of part B of chapter 436 of the laws of 1997, are amended and
     4  a new subparagraph (ix) is added to read as follows:
     5    (vii)  all  of the income of a dependent child living with a parent or
     6  other caretaker relative, who is receiving  such  aid  or  for  whom  an
     7  application  for  such  aid has been made, which is derived from partic-
     8  ipation in a program carried out under the federal job training partner-
     9  ship act (P.L. 97-300) provided, however, that in  the  case  of  earned
    10  income  such disregard must be applied for at least, but no longer than,
    11  six months per calendar year for each such child[.];
    12    (viii) any federal income taxes refunded by reason of section  thirty-
    13  two of the Internal Revenue Code of nineteen hundred eighty-six relating
    14  to  the  earned  income  tax  credit or any payment by an employer under
    15  section three thousand five hundred  seven  of  such  code  relating  to
    16  advance payment of the earned income tax credit[.]; and
    17    (ix)  all  of  the  income  of  a  person under the age of twenty-five
    18  receiving such aid or for whom an application for such aid has been made
    19  that is received as remuneration for participation in a government-fund-
    20  ed workforce development program administered by or under  the  auspices
    21  of  the  New York city department of youth and community development, or
    22  its successor  agency,  or  the  New  York  city  department  of  social
    23  services,  or  its  successor  agency, that provides paid internships or

     1  jobs lasting less than twelve months solely for persons under the age of
     2  twenty-five.
     3    § 2. This act shall take effect immediately.
