        AN ACT to amend the vehicle and traffic law, in relation to  eliminating
          additional fees for special license plates issued to veterans
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subdivisions 1 and 1-a of section 404 of  the  vehicle  and
     2  traffic law, subdivision 1 as amended by section 21 of part G of chapter
     3  59  of the laws of 2009 and subdivision 1-a as amended by chapter 105 of
     4  the laws of 2017, are amended to read as follows:
     5    1. The commissioner may issue  special  number  plates  to  applicants
     6  therefor  in  the same manner as other number plates are issued pursuant
     7  to this article. Such special number plates shall be  issued  only  upon
     8  payment  of  an  annual service charge of thirty-one dollars and twenty-
     9  five cents in addition to the regular fee  prescribed  by  section  four
    10  hundred one of this article. Application for special number plates shall
    11  be  made  in accordance with regulations promulgated by the commissioner
    12  with respect to issuance of such number plates.  Provided,  however,  in
    13  lieu  of the annual fee specified herein, the commissioner may establish
    14  specific categories of plates for which an annual fee of not  less  than
    15  eighteen dollars and seventy-five cents nor more than thirty-one dollars
    16  and  twenty-five  cents  may  be  charged subject to the approval of the
    17  director of the division of the budget.  Notwithstanding any  inconsist-
    18  ent  provision  of  this  section,  the difference collected between the
    19  special plates fee or service charge set forth in  this  subdivision  in
    20  effect  on  and after September first, two thousand nine and the special
    21  plates fee or service charge set forth in  this  subdivision  in  effect
    22  prior  to  such  date  shall be deposited to the credit of the dedicated
    23  highway and bridge trust fund.  Notwithstanding any other  provision  of
    24  this  subdivision  or  any  other provision of law, any registration and
    25  special number plates issued to a person as a result  of  such  person's

     1  service  in  a  branch of the armed forces of the United States shall be
     2  accompanied only by the required fee otherwise required to be  paid  for
     3  vehicle registration.
     4    1-a.  The  commissioner  may issue special number plates to applicants
     5  who are members of veterans organizations in the same  manner  as  other
     6  number  plates  are issued pursuant to this article. Such special number
     7  plates shall be issued only upon [(a)  payment  of  a  one-time  service
     8  charge  of  ten  dollars  in  addition  to  the regular registration fee
     9  prescribed by section  four  hundred  one  of  this  article,  and  (b)]
    10  submission  of  proof, satisfactory to the commissioner, that the appli-
    11  cant is presently a member of the veterans organization for  which  such
    12  plate  is  requested.  Such membership shall be verified annually by the
    13  applicant. Application for such plates shall be made in accordance  with
    14  regulations promulgated by the commissioner with respect to the issuance
    15  of  such  plates. Provided, however, that nothing contained herein shall
    16  be deemed to supersede the provisions of section  four  hundred  four-d,
    17  four  hundred  four-e,  four  hundred  four-h, four hundred four-i, four
    18  hundred four-j, four hundred four-k, four hundred four-p,  four  hundred
    19  four-aa, or four hundred four-dd of this article.
    20    § 2. Subdivision 3 of section 404-h of the vehicle and traffic law, as
    21  amended  by  chapter  415  of  the  laws  of 2001, is amended to read as
    22  follows:
    23    3. A distinctive plate issued pursuant to this section shall be issued
    24  in the same manner as other number plates upon payment  of  the  regular
    25  registration  fee prescribed by section four hundred one of this article
    26  [provided, however, that an additional one-time service  charge  of  ten
    27  dollars shall be charged for such plate].
    28    § 3. Subdivision 4 of section 404-j of the vehicle and traffic law, as
    29  amended  by  chapter  415  of  the  laws  of 2001, is amended to read as
    30  follows:
    31    4. Fee. A special plate  and  registration  issued  pursuant  to  this
    32  section  shall  be  issued  upon payment of the regular registration fee
    33  prescribed by section four hundred one of this article [provided, howev-
    34  er, that an additional one-time service charge of ten dollars  shall  be
    35  charged for such plate].
    36    § 4. Subdivision 3 of section 404-w of the vehicle and traffic law, as
    37  added by chapter 105 of the laws of 2005, is amended to read as follows:
    38    3. A distinctive plate issued pursuant to this section shall be issued
    39  in  the  same  manner as other number plates upon payment of the regular
    40  registration fee prescribed by section four hundred one  of  this  arti-
    41  cle[,  provided,  however, that an additional one-time service charge of
    42  ten dollars shall be charged for such plate].
    43    § 5. Subdivision 4 of section 404-w of the vehicle and traffic law, as
    44  added by chapter 493 of the laws of 2005, is amended to read as follows:
    45    4. A distinctive plate issued pursuant to this section shall be issued
    46  in the same manner as other number plates upon payment  of  the  regular
    47  registration  fee prescribed by section four hundred one of this article
    48  [provided, however, that an additional one time service  charge  of  ten
    49  dollars shall be charged for such plate].
    50    § 6. This act shall take effect immediately.
