        AN ACT to amend the penal law, in relation to assault on a  peace  offi-
          cer,  police  officer, firefighter, emergency medical services profes-
          sional, sanitation enforcement agent or New York city sanitation work-
          er
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section 1. Section 120.08 of the penal law, as added by chapter 476 of
     2  the laws of 2018, is amended to read as follows:
     3  § 120.08 Assault  on  a peace officer, police officer, firefighter [or],
     4             emergency medical services professional, sanitation  enforce-
     5             ment  agent  or  New York city sanitation worker in the first
     6             degree.
     7    A person is guilty of assault on  a  peace  officer,  police  officer,
     8  firefighter  [or],  emergency  medical services professional, sanitation
     9  enforcement agent or New York city sanitation worker in the first degree
    10  when, with intent to prevent a peace officer, police  officer,  a  fire-
    11  fighter,  including  a firefighter acting as a paramedic [or], emergency
    12  medical technician administering first aid in the course of  performance
    13  of duty as such firefighter, [or] an emergency medical service paramedic
    14  [or], emergency medical service technician, sanitation enforcement agent
    15  or  New York city sanitation worker from performing a lawful duty, he or
    16  she causes serious physical injury to such peace officer,  police  offi-
    17  cer,  firefighter,  paramedic  [or],  technician, sanitation enforcement
    18  agent or New York city sanitation worker.
    19    Assault on a peace officer, police officer, firefighter [or], emergen-
    20  cy medical services professional, sanitation enforcement  agent  or  New
    21  York city sanitation worker in the first degree is a class C felony.
    22    § 2. The penal law is amended by adding a new section 120.08-a to read
    23  as follows:

     1  § 120.08-a Assault  on  a  peace  officer,  police officer, firefighter,
     2               emergency   medical   services   professional,   sanitation
     3               enforcement agent or New York city sanitation worker in the
     4               second degree.
     5    A  person  is  guilty  of  assault on a peace officer, police officer,
     6  firefighter,  emergency  medical   services   professional,   sanitation
     7  enforcement  agent  or  New  York  city  sanitation worker in the second
     8  degree when, with intent to prevent a peace officer, police  officer,  a
     9  firefighter,  including a firefighter acting as a paramedic or emergency
    10  medical technician administering first aid in the course of  performance
    11  of  duty  as such firefighter, an emergency medical service paramedic or
    12  emergency medical service technician, sanitation enforcement  agent,  or
    13  New York city sanitation worker from performing a lawful duty, he or she
    14  causes physical injury to such peace officer, police officer, firefight-
    15  er, paramedic, technician, sanitation enforcement agent or New York city
    16  sanitation worker.
    17    Assault  on  a  peace  officer, police officer, firefighter, emergency
    18  medical services professional, sanitation enforcement agent or New  York
    19  city sanitation worker in the second degree is a class D felony.
    20    § 3. This act shall take effect on the first of November next succeed-
    21  ing the date on which it shall have become a law.
