STATE OF NEW YORK ________________________________________________________________________ 7219 2019-2020 Regular Sessions IN ASSEMBLY April 12, 2019 ___________ Introduced by M. of A. FAHY -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to the iden- tification of transportation network company drivers and vehicles The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (c) of subdivision 1 and subdivision 5 of section 2 1696 of the vehicle and traffic law, as added by section 2 of part AAA 3 of chapter 59 of the laws of 2017, are amended to read as follows: 4 (c) Upon review of all information received and retained by the TNC 5 and upon verifying that the individual is not disqualified pursuant to 6 this section from receiving a TNC driver permit, a TNC may issue a TNC 7 driver permit to the applicant. The TNC shall review all information 8 received relating to such applicant and hold such information for six 9 years along with a certification that such applicant qualifies to 10 receive a TNC driver permit. The department shall design and promulgate 11 a TNC driver identification card to be issued by a TNC when such TNC is 12 issuing a TNC driver permit to an applicant. Such TNC driver identifi- 13 cation card shall at a minimum include the TNC driver's name, photograph 14 and license plate number. A TNC driver who is providing the TNC service 15 or TNC prearranged trip shall prominently display such TNC driver iden- 16 tification card in the TNC vehicle. 17 5. The department shall promulgate regulations to ensure that each TNC 18 vehicle is easily identified as such and that the TNC for which the TNC 19 driver is providing the TNC service or TNC prearranged trip is distin- 20 guishable. Such marking shall be in such form as is approved by the 21 commissioner, which shall at a minimum include an illuminated sign indi- 22 cating the TNC for which the TNC driver is providing the TNC service or 23 TNC prearranged trip, and shall be attached, affixed or displayed in 24 such manner as he or she may prescribe by regulation. This act shall take effect on the thirtieth day after it shall 2 have become a law. Effective immediately, the addition, amendment 3 and/or repeal of any rule or regulation necessary for the implementation 4 of this act on its effective date are authorized to be made and 5 completed on or before such effective date.
