          bill  amended,  ordered  reprinted  as amended and recommitted to said
          committee -- again  reported  from  said  committee  with  amendments,

        AN  ACT  to  amend the vehicle and traffic law, in relation to the iden-
          tification of transportation network company drivers and vehicles

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.   Subdivision 5 of section 1692 of the vehicle and traffic
     2  law, as added by section 2 of part AAA of chapter  59  of  the  laws  of
     3  2017, is amended to read as follows:
     4    5.  A TNC's digital network shall display a picture of the TNC driver,
     5  and provide the make, model, color and license plate number of  the  TNC
     6  vehicle  utilized  for  providing  the  TNC  prearranged trip before the
     7  passenger enters the TNC vehicle.  The digital network shall also enable
     8  the passenger to scan, with the passenger's mobile device, the vehicle's
     9  machine-readable code or image required by section sixteen hundred nine-
    10  ty-six of this article, prior to entering the vehicle and prior  to  the
    11  release  of  payment,  in  order  to confirm that the vehicle is the one
    12  authorized for the passenger's prearranged trip.
    13    § 2. Paragraph (c) of subdivision 1 and subdivision 5 of section  1696
    14  of  the  vehicle  and  traffic law, as added by section 2 of part AAA of
    15  chapter 59 of the laws of 2017, are amended and a new subdivision  6  is
    16  added to read as follows:
    17    (c)  Upon  review  of all information received and retained by the TNC
    18  and upon verifying that the individual is not disqualified  pursuant  to
    19  this  section  from receiving a TNC driver permit, a TNC may issue a TNC
    20  driver permit to the applicant. The TNC  shall  review  all  information
    21  received  relating  to  such applicant and hold such information for six
    22  years along with  a  certification  that  such  applicant  qualifies  to

     1  receive  a TNC driver permit. The department shall design and promulgate
     2  a TNC driver identification card to be issued by a TNC when such TNC  is
     3  issuing  a TNC driver permit to an applicant.  Such TNC driver identifi-
     4  cation card shall at a minimum include the TNC driver's name, photograph
     5  and  license plate number. A TNC driver who is providing the TNC service
     6  or TNC prearranged trip shall prominently display such TNC driver  iden-
     7  tification card in the TNC vehicle.
     8    5. The department shall promulgate regulations to ensure that each TNC
     9  vehicle  is easily identified as such and that the TNC for which the TNC
    10  driver is providing the TNC service or TNC prearranged trip  is  distin-
    11  guishable.  Such  marking  shall  be  in such form as is approved by the
    12  commissioner, which shall at a minimum include an illuminated sign indi-
    13  cating the TNC for which the TNC driver is providing the TNC service  or
    14  TNC  prearranged  trip,  and  shall be attached, affixed or displayed in
    15  such manner as he or she may prescribe by regulation.
    16    6. The department shall promulgate regulations  to  require  each  TNC
    17  company  to  provide  each  TNC  driver  with a machine-readable code or
    18  image, and  to  require  such  machine-readable  code  or  image  to  be
    19  displayed on the outside of each TNC vehicle. Such machine-readable code
    20  or  image  shall be designed to allow the passenger to confirm, prior to
    21  entering the vehicle, that the vehicle is the authorized vehicle for the
    22  passenger's prearranged trip, using the TNC's  digital  network  as  set
    23  forth  in subdivision five of section sixteen hundred ninety-two of this
    24  article.
    25    § 3. Section 1691 of the vehicle and traffic law is amended by  adding
    26  a new subdivision 8 to read as follows:
    27    8. "Machine-readable code or image" means an optical label that can be
    28  scanned  using  a  special  scanner  or  a personal mobile device with a
    29  built-in camera.
    30    § 4. This act shall take effect on the thirtieth day  after  it  shall
    31  have  become a law; provided, however that section one of this act shall
    32  take effect on the one hundred eightieth day after it shall have  become
    33  a  law.  Effective immediately, the addition, amendment and/or repeal of
    34  any rule or regulation necessary for the implementation of this  act  on
    35  its  effective date are authorized to be made and completed on or before
    36  such effective date.
