STATE OF NEW YORK ________________________________________________________________________ 7386 2019-2020 Regular Sessions IN ASSEMBLY April 29, 2019 ___________ Introduced by M. of A. WOERNER -- read once and referred to the Commit- tee on Environmental Conservation AN ACT to amend the executive law, in relation to allowing soil and water conservation districts, acting in cooperation with a local government, to be active participants in the local waterfront revital- ization grant program The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 911 of the executive law is amended by adding a new 2 subdivision 8 to read as follows: 3 8. "Soil and water conservation district" shall mean a soil and water 4 conservation district as defined in subdivision one of section three of 5 the soil and water conservation districts law, where such district is 6 acting pursuant to a written agreement with a local government or local 7 governments to prepare a waterfront revitalization program for the 8 purposes of this article. 9 § 2. Subdivisions 1, 2 and 3 and the opening paragraph of subdivision 10 4 of section 915 of the executive law, subdivision 1 as amended by chap- 11 ter 454 of the laws of 2001, subdivision 2 as amended by chapter 842 of 12 the laws of 1981, subdivision 3 and the opening paragraph of subdivision 13 4 as added by chapter 840 of the laws of 1981, are amended to read as 14 follows: 15 1. It is the intention of this article to offer the fullest possible 16 support by the state and its agencies to those local governments that 17 desire to revitalize their waterfronts. Accordingly, any local govern- 18 ment or two or more local governments acting jointly or any soil and 19 water conservation district which has any portion of its jurisdiction 20 contiguous to the state's coastal waters or inland waterways and which 21 desires to participate may submit a waterfront revitalization program to 22 the secretary as herein provided. The secretary may provide technical and financial assistance as 2 provided in sections nine hundred seventeen and nine hundred eighteen of 3 this article to any local government for the preparation of a waterfront 4 revitalization program for the purposes of this article. The secretary 5 may also provide technical assistance as provided in section nine 6 hundred seventeen of this article to any soil and water conservation 7 district for the preparation of a waterfront revitalization program for 8 the purposes of this article. 9 3. A local government or two or more local governments acting jointly 10 or any soil and water conservation district which intends to submit a 11 waterfront revitalization program for the purposes of this article is 12 strongly encouraged to consult, during its preparation, with other enti- 13 ties that may be affected by its program, including local governments, 14 soil and water conservation districts, county and regional agencies, 15 appropriate port authorities, community based groups and state and 16 federal agencies. On request by the local government, the secretary 17 shall take appropriate action to facilitate such consultation. 18 The secretary shall prepare and distribute guidelines and regulations 19 for local governments or soil and water conservation districts desiring 20 to prepare, or cause to be prepared, a waterfront revitalization program 21 (hereinafter referred to as the "program"). Such guidelines shall 22 provide that the program will be consistent with the policies and 23 purposes of this article generally and shall include, but not be limited 24 to: 25 § 3. Section 917 of the executive law, as added by chapter 840 of the 26 laws of 1981, is amended to read as follows: 27 § 917. Technical assistance. The secretary shall encourage and assist 28 local governments and soil and water conservation districts in the prep- 29 aration of waterfront revitalization programs and in the administration 30 and implementation of approved programs. Such assistance shall be 31 provided on request by the local government or soil and water conserva- 32 tion district and shall include, as may be deemed appropriate by the 33 secretary, the provision of maps, data, criteria, model implementation 34 provisions, and technical counsel and advice. In addition, the secretary 35 shall facilitate consultation and coordination among local, county, 36 regional, state and federal agencies and community based groups in 37 connection with the preparation and administration of approved water- 38 front revitalization programs, and to facilitate the development of 39 projects called for by approved programs. 40 § 4. Subdivision 3 of section 920 of the executive law, as added by 41 chapter 840 of the laws of 1981, is amended to read as follows: 42 3. The secretary shall make this inventory available to state agen- 43 cies, local governments, soil and water conservation districts and the 44 public for planning purposes. 45 § 5. This act shall take effect immediately.
