STATE OF NEW YORK ________________________________________________________________________ 7415--A 2019-2020 Regular Sessions IN ASSEMBLY May 1, 2019 ___________ Introduced by M. of A. REYES -- read once and referred to the Committee on Governmental Employees -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the civil service law, in relation to requiring the department of civil service to create and distribute a pamphlet regarding union membership of civil service employees The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The civil service law is amended by adding a new section 2 154 to read as follows: 3 § 154. Union membership guidance. 1. The department shall create a 4 pamphlet that sets forth in simple and understandable terms the follow- 5 ing minimum requirements: 6 (a) The definition of a public employer; 7 (b) An explanation that public-sector workers have the right to union- 8 ize pursuant to state and local law; 9 (c) The prohibition of public employers interfering with public-sector 10 employees right to unionize; and 11 (d) The loss of benefits to public employees who choose not to join a 12 union pursuant to subdivision two of section two hundred-nine-a of this 13 chapter. 14 2. The department shall distribute to all current civil service 15 employees the pamphlet required pursuant to this section. Within thirty 16 days of an employee first being employed or reemployed in a civil 17 service position, the department shall distribute the pamphlet required 18 pursuant to this section to such employee. 19 3. The department shall make available on its website the pamphlet 20 required pursuant to this section. 21 § 2. This act shall take effect on the ninetieth day after it shall 22 have become a law. Effective immediately, the addition, amendment 23 and/or repeal of any rule or regulation necessary for the implementation 24 of this act on its effective date are authorized to be made and 25 completed on or before such effective date.
