        AN  ACT  to  amend the insurance law, in relation to supplementary unin-
          sured and underinsured motorist coverage for police agencies
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section 1. Paragraph 5 of subsection (f) of section 3420 of the insur-
     2  ance  law,  as  amended by chapter 11 of the laws of 2013, is amended to
     3  read as follows:
     4    (5) This paragraph shall apply to a policy that provides supplementary
     5  uninsured/underinsured motorist insurance coverage for bodily injury and
     6  is a policy: (A) issued or delivered in this state that insures  against
     7  liability  arising  out of the ownership, maintenance, and use of a fire
     8  vehicle, as defined in section one hundred fifteen-a of the vehicle  and
     9  traffic  law,  where  the fire vehicle is principally garaged or used in
    10  this state, or a police vehicle, as defined in section one hundred thir-
    11  ty-two-a of the vehicle and traffic law; or (B) as  specified  in  para-
    12  graph  one  of  this subsection.   Every such policy that insures a fire
    13  department, fire company, as defined  in  section  one  hundred  of  the
    14  general  municipal law, an ambulance service, [or] a voluntary ambulance
    15  service, as defined in section three thousand one of the  public  health
    16  law, or a police agency, as defined in section eight hundred thirty-five
    17  of    the    executive    law,    shall   provide   such   supplementary
    18  uninsured/underinsured motorist  insurance  coverage  to  an  individual
    19  employed  by  or  who  is a member of the fire department, fire company,
    20  ambulance service, [or] voluntary ambulance service,  or  police  agency
    21  and  who  is injured by an uninsured or underinsured motor vehicle while
    22  acting in the scope of the individual's duties for the fire  department,
    23  fire  company,  ambulance  service, [or] voluntary ambulance service, or
    24  police agency covered under the policy, except with respect to  the  use

     1  or  operation by such an individual of a motor vehicle not covered under
     2  the policy.
     3    §  2.  This act shall take effect immediately and shall apply to poli-
     4  cies and contracts issued, renewed, modified, altered or amended  on  or
     5  after such effective date.
