        AN  ACT to amend the education law, in relation to including bus drivers
          and monitors as school personnel for policies and procedures  concern-
          ing school safety plans

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraphs a, b, and g of subdivision 2 of  section  2801-a
     2  of the education law, as amended by section 1 of part B of chapter 54 of
     3  the laws of 2016, are amended to read as follows:
     4    a. policies and procedures for responding to implied or direct threats
     5  of  violence by students, teachers, other school personnel including bus
     6  drivers and monitors, as well  as  visitors  to  the  school,  including
     7  threats  by  students against themselves, which for the purposes of this
     8  section shall include suicide;
     9    b. policies and procedures for  responding  to  acts  of  violence  by
    10  students,  teachers,  other  school  personnel including bus drivers and
    11  monitors, as well as visitors to the school, including consideration  of
    12  zero-tolerance policies for school violence;
    13    g.  policies and procedures for the dissemination of informative mate-
    14  rials regarding the early detection of  potentially  violent  behaviors,
    15  including but not limited to the identification of family, community and
    16  environmental  factors,  to  teachers,  administrators, school personnel
    17  including bus drivers and monitors,  persons  in  parental  relation  to
    18  students  of the district, students and other persons deemed appropriate
    19  to receive such information;
    20    § 2. Subdivision 4 of section 2801-a of the education law, as  amended
    21  by  section 1 of part B of chapter 54 of the laws of 2016, is amended to
    22  read as follows:

     1    4. Each district-wide school safety team shall  be  appointed  by  the
     2  board  of  education,  or  the chancellor in the case of the city school
     3  district of the city of New York, and shall include but not  be  limited
     4  to  representatives  of  the  school  board, teacher, administrator, and
     5  parent  organizations, school safety personnel, and other school person-
     6  nel including bus drivers and monitors. At the discretion of  the  board
     7  of  education,  or the chancellor in the case of the city of New York, a
     8  student may be allowed to  participate  on  the  safety  team,  provided
     9  however,  that  no  portion  of  a confidential building-level emergency
    10  response plan shall be shared with such student nor shall  such  student
    11  be  present  where  details  of  a confidential building-level emergency
    12  response plan or confidential  portions  of  a  district-wide  emergency
    13  response  strategy are discussed. Each building-level emergency response
    14  team shall be appointed by the building principal,  in  accordance  with
    15  regulations or guidelines prescribed by the board of education, chancel-
    16  lor or other governing body. Such building-level teams shall include but
    17  not  be limited to representatives of teacher, administrator, and parent
    18  organizations,  school  safety  personnel  and  other  school  personnel
    19  including  bus  drivers and monitors, community members, law enforcement
    20  officials, fire officials or other emergency response agencies, and  any
    21  other  representatives  the  board  of  education,  chancellor  or other
    22  governing body deems appropriate.
    23    § 3. This act shall take effect immediately.
