        Introduced by M. of A. LAVINE -- read once and referred to the Committee
          on Election Law

        AN  ACT  to  amend  the election law, in relation to the form of primary
          election ballots; to amend a chapter of the laws of 2019, amending the
          election law relating to enacting the voter friendly  ballot  act,  as
          proposed  in  legislative  bills numbers S.   2300-A and A. 2682-A, in
          relation  to  the  effectiveness  thereof;   and   repealing   certain
          provisions of such law relating thereto

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph (h) of subdivision 2  of  section  7-114  of  the
     2  election law is REPEALED.
     3    §  2.  Paragraph (c) of subdivision 2 of section 7-114 of the election
     4  law, as amended by a chapter of the laws of 2019, amending the  election
     5  law  relating  to enacting the voter friendly ballot act, as proposed in
     6  legislative bills numbers S. 2300-A and A.  2682-A, is REPEALED.
     7    § 3. Subdivision 1 of section 16-104 of the election law is amended to
     8  read as follows:
     9    1. The form and content of any ballot, or portion thereof, to be  used
    10  in  an  election, and the right to use any emblem design, [color,] party
    11  or independent body name, may be contested in a proceeding instituted in
    12  the supreme court by any aggrieved candidate or by the chairman  of  any
    13  party committee or independent body.
    14    §  4.  Section  17  of  a  chapter  of  the laws of 2019, amending the
    15  election law relating to enacting the  voter  friendly  ballot  act,  as
    16  proposed  in  legislative  bills  numbers  S. 2300-A and A.   2682-A, is
    17  amended to read as follows:
    18    § 17. This act shall take effect [immediately] July 1, 2020 and  shall
    19  apply  to  ballots  to  be used for elections occurring on or after [the
    20  first day of July next succeeding the year in which it shall have become
    21  a law] such effective date. Effective immediately, the addition,  amend-

     1  ment and/or repeal of any rule or regulation necessary for the implemen-
     2  tation  of  this act on its effective date are authorized to be made and
     3  completed on or before such effective date.
     4    §  5.  This act shall take effect immediately; provided, however, that
     5  sections one and three of this act shall take effect  January  1,  2020;
     6  and  provided  further that section two of this act shall take effect on
     7  the same date and in the same manner as a chapter of the laws  of  2019,
     8  amending the election law relating to enacting the voter friendly ballot
     9  act,  as  proposed in legislative bills numbers S. 2300-A and A. 2682-A,
    10  takes effect.
