        AN ACT to create a moratorium on the annexation of agricultural land  by
          localities for an industrial use

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Moratorium on the annexation of agricultural land.  1.  For
     2  the purposes of this act:
     3    (a)  "agricultural  land"  shall include any lands that support a farm
     4  operation, that are used in agricultural production, or any lands refer-
     5  enced in section 301 of the agriculture and markets law; and
     6    (b) "industrial use" shall mean the use of land as an industrial  park
     7  or  a  distribution center as defined in subdivision 6 of section 352 of
     8  the economic development law.
     9    2. Notwithstanding any provision of law  to  the  contrary,  there  is
    10  hereby established a moratorium upon the annexation of agricultural land
    11  in  this state by a county, town, village, or municipality for an indus-
    12  trial use.  The moratorium shall continue for a period of one year  from
    13  the  effective date of this act or until the commissioner of the depart-
    14  ment of environmental conservation determines such moratorium  shall  be
    15  lifted.
    16    § 2. This act shall take effect immediately.
