        AN ACT to amend the highway law, in relation to allowing for  the  emer-
          gency repair of state highways within the Town of Somers

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The highway law is amended by adding a new section 142-e to
     2  read as follows:
     3    § 142-e. Emergency repair of state highways. 1. The town board of  the
     4  town  of  Somers, Westchester county, may authorize the town superinten-
     5  dent to repair  state  routes  thirty-five,  one  hundred,  one  hundred
     6  sixteen,  one  hundred  eighteen,  one hundred thirty-eight, one hundred
     7  thirty-nine and two hundred two within the town where a section  of  the
     8  state highway:
     9    (a) requires immediate repairs;
    10    (b)  has  caused damage to multiple vehicles traveling on the highway;
    11  and
    12    (c) will not be repaired by the department in a timely manner.
    13    2. Upon the town superintendent repairing a state highway, the depart-
    14  ment shall reimburse the town for their actual costs for performing  the
    15  repair.  Moneys  received  by  a town pursuant to the provisions of this
    16  section shall be first applied to the credit of the fund  authorized  by
    17  subdivision four of section one hundred forty-one of this article to the
    18  extent that any expense incurred was originally charged thereto, and the
    19  balance of such moneys, if any, shall be credited to the fund authorized
    20  by subdivision three of section one hundred forty-one of this article.
    21    § 2. This act shall take effect immediately.
