          the Committee on Environmental Conservation

        AN ACT to implement a constitutional amendment authorizing the placement
          of public utility lines and bike paths  in  the  forest  preserve  and
          establishing a health and safety land account

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Pursuant to section 1 of  article  fourteen  of  the  State
     2  Constitution, as amended at the general election held in November, 2017,
     3  the  legislature  approves  the  lands  to  be conveyed to the State for
     4  inclusion in the forest preserve as described in section three  of  this
     5  act,  which  adds  in excess of the two hundred fifty acres required for
     6  the creation of the health and safety land account  authorized  pursuant
     7  to the constitution and title twenty-one of article nine of the environ-
     8  mental conservation law.
     9    § 2. Title to the land described in section three of this act shall be
    10  approved  by  the  attorney  general, and the deeds to the people of the
    11  state of New York of such described  lands  shall  be  approved  by  the
    12  attorney general as to the form and manner of execution and recordabili-
    13  ty  prior  to  its  delivery  to  the respective county clerk office for
    14  recording.
    15    § 3. The lands to be conveyed to the state are described  as  follows:
    16  ALL  THOSE  CERTAIN PIECES OR PARCELS OF LAND situate lying and being in
    17  the Town of Olive, Ulster County and in the Town of Moriah, Essex County
    18  and State of New York being generally described as Ulster  County,  Town
    19  of  Olive  Tax  Parcels  45.1-1-1.212  and  45.1-1-1.331,  consisting of
    20  approximately 214 acres of land and as Essex County, Town of Moriah  Tax
    21  Parcels  96.3-1-21.001, 106.00-1-1.1, 106.00-1-2, 106.00-1-3, 106.00-1-4
    22  and 106.00-1-22, consisting of approximately 1206 acres  of  land,  said
    23  parcels being more specifically described to wit:

     1    ALL  THAT  PIECE OR PARCEL OF LAND SITUATE LYING AND BEING in the Town
     2  of Olive, County of Ulster and State of  New  York,  being  bounded  and
     3  described as follows:
     4    BEGINNING at a point in the center of Watson Hollow Road (County Route
     5  42)  at  the westerly corner of lands now or formerly of Lisa Hubbard as
     6  described in Liber 4214 of deeds at page 47, and runs thence along  said
     7  lands South 48°44'45" East 494.90 feet to a found rebar set in a pile of
     8  stones  on  the  westerly  boundary of lands now or formerly of Denis J.
     9  Moran & Judith A. Moran as described in Liber 554 of deeds at page  335,
    10  said  last  mentioned  course at distances of 20.00 feet and 250.00 feet
    11  passes through 5/8 inch diameter rebars with  a  plastic  cap  inscribed
    12  "Brooks & Brooks---Property Line" set,
    13    thence  along  said  lands  of  Moran  the  following five courses and
    14  distances:
    15    1. South 22°11'37" West 270.37 feet to a found 1/2 inch diameter metal
    16  pipe set at the northerly end of a stone wall,
    17    2. along said wall South 03°12'32" East 220.04 feet to  a  cornered  8
    18  inch diameter Birch tree,
    19    3. South 42°52'59" East 198.81 feet to a found 2 foot diameter pile of
    20  stones,
    21    4.  South  38°10'19"  East  433.80 feet to a found stone on end in a 2
    22  foot diameter pile of stones and
    23    5. South 25°58'16" East 1,179.61 feet to a found 2 foot diameter  pile
    24  of  stones at the northwesterly corner of lands of the State of New York
    25  as described in Liber 551 of deeds at page 573,
    26    thence along said lands of the State of New York South 26°19'42"  East
    27  659.82 feet to a found 4 foot diameter pile of stones, thence continuing
    28  along  said lands of the State of New York South 57°23'00" West 1,099.28
    29  feet to a found 5 foot diameter pile  of  stones  at  the  southeasterly
    30  corner  of  lands  now  or  formerly of Corrine E. Lopez as described in
    31  Liber 5198 of deeds at page 248,
    32    thence along said lands the following two courses and distances:
    33    1. North 37°59'13" West 2,528.23 feet to a  5/8  inch  diameter  rebar
    34  with a plastic cap inscribed "Brooks & Brooks" in a pile of stones to be
    35  set and
    36    2.  North 02°14'19" East 150.00 feet to the center of the Bush Kill in
    37  the southeasterly line of lands now or formerly of Margaret & Rijk Riet-
    38  veld as described in  Liber  3797  of  deeds  at  page  221,  said  last
    39  mentioned  course at a distance of 105.67 feet passes through a 5/8 inch
    40  diameter rebars with a plastic cap inscribed "Brooks & Brooks---Property
    41  Line" set,
    42    thence along said lands the following two courses and distances:
    43    1. Along the center of said Kill North 33°14'19" East 149.00 feet to a
    44  point and
    45    2. North 42°18'27" West 440.37 feet  to  the  center  of  said  Watson
    46  Hollow Road said last mentioned course at a distance of 47.3 feet passes
    47  through  a  found  rebar  and  a distance of 414.2 feet passes through a
    48  found metal pipe,
    49    thence along the center of said road North 43°06'00" East  50.16  feet
    50  to  a  northwesterly corner of lands now or formerly of Amanda C. Insall
    51  as described in Liber 5681 of deeds at page 86,
    52    thence along said lands the following four courses and distances:
    53    1. South 42°18'27" East 430.18 feet to the center of said  Bush  Kill,
    54  said  last  mentioned  course  at a distance of 26.0 feet and 390.4 feet
    55  passes through found rebars,

     1    2. The remaining four courses and distances being along the center  of
     2  said Kill North 31°49'38" East 86.57 feet,
     3    3. North 39°53'17" East 80.20 feet and
     4    4.  North  45°37'33"  East  192.47 feet to the southwesterly corner of
     5  lands now or formerly of R. Todd Green and Amie M. Green as described in
     6  Liber 5652 at page 104,
     7    thence along said lands, along the center of said Kill  the  following
     8  five courses and distances:
     9    1. North 59°48'03" East 141.90 feet,
    10    2. North 64°39'25" East 92.25 feet,
    11    3. North 50°04'04" East 66.80 feet,
    12    4. North 43°32'40" East 126.57 feet and
    13    5. North 18°42'39" East 242.58 feet,
    14    thence  leaving  the  said  Kill continuing along said lands of Green,
    15  North 50°35'36" West 313.44 feet to the center  of  said  Watson  Hollow
    16  Road,  said  last  mentioned  course  at  a distance of 39.4 feet passes
    17  through a found rebar and at a distance of 284.7 feet passes  through  a
    18  found  rebar,  thence  along  the  center of said road the following six

    21    2. North 65°01'26" East 86.26 feet,
    22    3. North 60°36'28" East 74.13 feet,
    23    4. North 56°38'48" East 171.43 feet,

    25    6. North 56°37'12" East 73.82 feet to the point of beginning.
    26    CONTAINING Ninety-three and ninety-one hundredths (93.91) Acres.

    29  Town  of  Olive, County of Ulster and State of New York being designated
    30  as Lot 2 as shown on a map entitled "Final Map of lot line revision  and
    31  subdivision  of  lands of Pamela Trippel" last revised June 17th 2017 by
    32  Brooks & Brooks, Land Surveyors,  P.C.,  filed  in  the  County  Clerk's
    33  Office  on  July 19th 2017 as map number 17-131 A and 17-131 B, said lot
    34  being bounded and described as follows:
    35    BEGINNING at a point in the center of  the  County  Highway  known  as
    36  Watson  Hollow Road (County Route 42) in the northeasterly line of lands
    37  now or formerly of Jean Marie Duffy as described in Liber 5304 of  deeds
    38  at page 286 and runs thence from said point of beginning along said land
    39  of  Duffy  generally along the center of a stone wall the following five
    40  courses and distances:

    42    2. North 44°49'02" West 148.60 feet,
    43    3. North 70°14'11" West 12.82 feet,
    44    4. South 83°02'58" West 167.66 feet, and leaving said wall

    47  1202 of deeds at page 246 marked by a set 5/8 inch diameter rebar with a

    16  acre  lot as shown on the above referenced filed map marked by a set 5/8
    17  inch diameter rebar with a "Brooks & Brooks" plastic cap in  a  pile  of
    18  stones,
    19    thence  along  said  6.56  acre lot, generally along a blazed line the
    20  following two courses and distances:
    21    1. South 44°49'02" East 138.57 feet to a set 5/8 inch  diameter  rebar

    23    2.  South  49°44'29"  East  228.73 feet to the center of the aforemen-
    24  tioned Watson Hollow Road, said last mentioned course at a  distance  of
    25  203.73  feet passes through a set 5/8 inch diameter rebar with a "Brooks

    27    thence along the center of said road South 43°06'00" West 100.12  feet
    28  to the point of beginning.
    29    CONTAINING One hundred twenty and twelve hundredths (120.12) acres.
    30    BEARINGS  are  with reference to Ulster County filed map number 11610,
    31  Magnetic North 2009.
    32    ALSO ALL THAT PIECE OR PARCEL OF LAND SITUATE LYING AND BEING Lot 363,
    33  Paradox Tract, Town or Moriah, County of Essex and  State  of  New  York
    34  located  on  the  southerly  side of Ensign Pond Road (and also known as
    35  County Route 4):
    36    BEGINNING at a point located in the northeast  corner  of  the  parcel
    37  being  herein  conveyed and said point being in the center of the Ensign
    38  Pond Road proceeding South 09°23'51" West 25 feet to an iron rod,
    39    thence proceeding South 09°23'51' West 866.05 feet to a drill hold and
    40  plug on a ledge marker with stones and being the southeast corner of the
    41  parcel herein,
    42    thence proceeding North 81°02'03" West 1,044.36 feet to a  drill  hole
    43  and  plug  on a ledge marked with iron and stones and marking the south-
    44  west corner of the parcel herein,
    45    thence proceeding North 10°55'50" East 917 feet  more  or  less  to  a
    46  point in the center of the Ensign Pond Road,
    47    thence  proceeding  along  the  center  line of Ensign Pond Road as it
    48  winds and turns 1075 feet more or less to the point or place  of  begin-
    49  ning.
    50    CONTAINING Twenty one and fifty seven hundredths (21.57) acres.
    51    BEARINGS are with reference to Survey dated January 28, 1983 by Martin
    52  B.  Thompson, Land Surveyor.
    53    ALSO  ALL  THAT  PIECE  OR  PARCEL  OF  LAND SITUATE LYING AND BEING a
    54  portion of Lots 363 and 364 and all of Lots 345, 344, 317, 328, 318  and
    55  327  of  the  Paradox  Tract  in the Town of Moriah, County of Essex and
    56  State of New York and being described as follows:

     5  15°18'41"  East, along the westerly bounds of said Saboski, 46.4 feet to
     6  a 1 inch iron pipe, thence South  07°23'29"  West,  along  said  bounds,
     7  807.7 feet to a 1 inch iron pipe and stones,
     8    thence  North  67°38'50"  East, along the southerly bounds of Saboski,
     9  1,230.4 feet to a bolt found set in ledgerock with stones  piled  around
