AN ACT to amend the vehicle and traffic law, in relation to making tech-
nical corrections to provisions relating to bicycles with electric
assist and electric scooters
The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:
1 Section 1. Paragraph (a) of subdivision 8 of section 1282 of the vehi-
2 cle and traffic law, as added by a chapter of the laws of 2019, amending
3 the vehicle and traffic law relating to bicycles with electric assist
4 and electric scooters, as proposed in legislative bills numbers S.5294-A
5 and A.7431-B, is amended to read as follows:
6 (a) The governing body of any city, town or village may, by local law,
7 ordinance, order, rule or regulation, authorize and regulate shared
8 electric scooter systems within such city, town or village. No such
9 shared systems shall operate within a city, town or village except as
10 authorized by such local law, ordinance, order, rule or regulation. No
11 such shared electric scooter system shall operate on public highways in
12 a county with a population of no less than one million five hundred
13 [eighty-six] eighty-five thousand and no more than one million five
14 hundred eighty-seven thousand as of the two thousand ten decennial
15 census. For the purposes of this subdivision, the term shared electric
16 scooter system shall mean a network of self-service and publicly avail-
17 able electric scooters, and related infrastructure, in which an electric
18 scooter trip begins and/or ends on any public highway.
19 § 2. This act shall take effect on the same date and in the same
20 manner as section 6 of a chapter of the laws of 2019, amending the vehi-
21 cle and traffic law relating to bicycles with electric assist and elec-
22 tric scooters, as proposed in legislative bills numbers S.5294-A and
23 A.7431-B, takes effect.
