Bill Title: Requires that horses shall be allowed sufficient time to recuperate from normal exercise-induced micro-damage to the bones and any other injuries; prohibits horses from receiving any therapeutic medication or invasive treatment within the two weeks before a race or a workout where such horse shall be running at a racing pace; prohibits striking a horse with a riding crop, whip or similar implement, for the purpose of urging such horse to move forward or to increase the pace at which such horse is moving forward.

STATE OF NEW YORK ________________________________________________________________________ 8556 2019-2020 Regular Sessions IN ASSEMBLY August 23, 2019 ___________ Introduced by M. of A. MOSLEY -- read once and referred to the Committee on Racing and Wagering AN ACT to amend the racing, pari-mutuel wagering and breeding law, in relation to equine drug testing regulations and prohibiting striking a horse during a race The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 902 of the racing, pari-mutuel 2 wagering and breeding law, as amended by section 2 of part JJ of chapter 3 59 of the laws of 2019, is amended to read as follows: 4 1. In order to assure the public's confidence and continue the high 5 degree of integrity in racing at the pari-mutuel betting tracks, equine 6 drug testing at race meetings shall be conducted by a state college or 7 at a land grant university within this state. The gaming commission 8 shall promulgate any rules and regulations necessary to implement the 9 provisions of this section, including administrative penalties of loss 10 of purse money, fines, or denial, suspension or revocation of a license 11 for racing drugged horses. Such regulations shall, at a minimum, 12 include: 13 (a) a requirement that horses shall be allowed sufficient time to 14 recuperate from normal exercise-induced micro-damage to the bones and 15 any other injuries; and 16 (b) no horse shall receive any therapeutic medication or invasive 17 treatment within the two weeks before a race or a workout where such 18 horse shall be running at a racing pace. 19 § 2. The racing, pari-mutuel wagering and breeding law is amended by 20 adding a new section 912 to read as follows: 21 § 912. Prohibition on striking horses. No person participating in a 22 race pursuant to the provisions of this chapter shall strike a horse 23 with a riding crop, whip or similar implement, for the purpose of urging EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. This act shall take effect on the thirtieth day after it shall 4 have become a law. Effective immediately, the addition, amendment and/or 5 repeal of any rule or regulation necessary for the implementation of 6 this act on its effective date are authorized to be made and completed 7 on or before such effective date.
