AN ACT to amend the state technology law, in relation to state agency
websites required to offer a mobile friendly form
The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:
1 Section 1. Section 210 of the state technology law, as added by a
2 chapter of the laws of 2023 amending the state technology law relating
3 to state agency websites, as proposed in legislative bills numbers S.
4 5410 and A. 6972, is renumbered section 103-c and amended to read as
5 follows:
6 § 103-c. State agency websites; mobile friendly websites. All state
7 agency websites, as defined in section two hundred two of this [article]
8 chapter, shall offer a mobile friendly form and shall be made available
9 for all mobile devices that support such technology, provided that such
10 requirement shall only apply to websites created or modified with chang-
11 es to form or function after the effective date of this section and
12 prior to January first, two thousand twenty-seven, and to all state
13 agency websites thereafter. For the purposes of this section, "mobile
14 friendly" shall mean, with respect to a website, that such website is
15 configured in such a way that such website may be navigated, viewed and
16 accessed on a smartphone, tablet computer, or similar mobile device. For
17 the purposes of this section, "changes to form or function" shall mean
18 modifications to the visual presentation, informational organization,
19 website infrastructure, or user utility of the website, including but
20 not limited to:
21 1. redesigns of site layout, color schemes, graphics, branding
22 elements, or other aesthetic components; or
23 2. integration of dynamic interfaces.
24 § 2. This act shall take effect on the same date and in the same
25 manner as a chapter of the laws of 2023 amending the state technology
26 law relating to state agency websites, as proposed in legislative bills
27 numbers S. 5410 and A. 6972, takes effect.
