        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          requiring products containing glyphosate to have a warning label

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The environmental conservation law is amended by  adding  a
     2  new section 37-0115 to read as follows:
     3  § 37-0115. Products containing glyphosate; warning label.
     4    1.  Any  product  containing glyphosate which is distributed, sold, or
     5  offered for sale or use in the state shall  have  a  label  clearly  and
     6  conspicuously  stating  that  such  product contains glyphosate and that
     7  glyphosate may be carcinogenic.
     8    2. For the purposes of this section, glyphosate shall mean a synthetic
     9  compound that is a  non-selective  systemic  herbicide,  also  known  as
    10  N-(phosphonomethyl) glycerine with a chemical formula of C3H8NO5P.
    11    3.  The  department  is  authorized to promulgate such rules and regu-
    12  lations as it shall deem necessary to implement the provisions  of  this
    13  section.
    14    §  2.  This  act shall take effect on the ninetieth day after it shall
    15  have become a law. Effective immediately, the addition, amendment and/or
    16  repeal of any rule or regulation necessary  for  the  implementation  of
    17  this  act  on its effective date are authorized to be made and completed
    18  on or before such effective date.
