STATE OF NEW YORK ________________________________________________________________________ 9031 IN ASSEMBLY January 10, 2020 ___________ Introduced by M. of A. VANEL -- read once and referred to the Committee on Racing and Wagering AN ACT to amend the racing, pari-mutuel wagering and breeding law, in relation to requiring all advertisements for gambling and sports betting to include warnings about potential harmful and addictive effects of gambling The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (a) of subdivision 1 of section 1363 of the 2 racing, pari-mutuel wagering and breeding law, as added by chapter 174 3 of the laws of 2013, is amended and a new subdivision 3-a is added to 4 read as follows: 5 (a) "advertisement" shall mean any notice or communication to the 6 public or any information concerning gaming, gambling, sports wagering, 7 as defined in section thirteen hundred sixty-seven of this article, the 8 gaming-related business of a gaming facility licensee or applicant 9 through broadcasting, including but not limited to radio broadcasting 10 and television broadcasting, publication or any other means of dissem- 11 ination, including electronic dissemination. Promotional activities are 12 considered advertisements for purposes of this section. 13 3-a. Each advertisement shall, clearly and conspicuously, state a 14 warning about the potential harmful and addictive effects of gambling. 15 The commission shall promulgate rules and regulations regarding such 16 effects and shall include such in all applicable advertisements. 17 § 2. This act shall take effect on the sixtieth day after it shall 18 have become a law. Effective immediately, the addition, amendment and/or 19 repeal of any rule or regulation necessary for the implementation of 20 this act on its effective date are authorized to be made and completed 21 on or before such effective date.
