       AN  ACT  to  amend  the  education  law,  in relation to school district
         contingency budgets
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.    Subparagraphs  (vi), (vii), and (vii) of paragraph b of
    2  subdivision 4 of section 2023 of the education law, subparagraph (vi) as
    3  separately amended by section 1 of part D2 of chapter 57 and chapter 422
    4  of the laws of 2007, subparagraph (vii) as added by section 1 of part D2
    5  of chapter 57 of the laws of 2007, and subparagraph (vii)  as  added  by
    6  chapter 422 of the laws of 2007, are amended and a new subparagraph (ix)
    7  is added to read as follows:
    8    (vi)  non-recurring  expenditures  in the prior year's school district
    9  budget; [and]
   10    (vii) expenditures for payments to charter schools pursuant to section
   11  twenty-eight hundred fifty-six of this chapter[.];
   12    [(vii)] (VIII) expenditures for self-supporting programs. For purposes
   13  of this subparagraph, "self-supporting programs" shall mean any programs
   14  that are entirely funded by private funds that cover all  the  costs  of
   15  the program[.]; AND
   16    (IX) EXPENDITURES FOR ANY PENSIONS OR RETIREMENT BENEFITS.
   17    S 2. This act shall take effect immediately.
