MILLER -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to requiring completion of a training program on the treatment of those with intellectual and developmental disabilities and chronic illness for certain medical professionals The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The education law is amended by adding a new section 6524-a 2 to read as follows: 3 § 6524-a. Mandatory training on the treatment of those with intellec- 4 tual and developmental disabilities and chronic illness. 1. All physi- 5 cians, in order to maintain his or her license in good standing, shall 6 complete a biennial training program on the treatment of those with 7 intellectual and developmental disabilities and chronic illness. 8 2. Such training program shall be developed and administered by the 9 department in conjunction with the department of health. 10 3. Such training program shall include, but not be limited to, the 11 following: 12 a. didactic classroom instruction, experiential learning, and online 13 learning, totaling not less than six hours; and 14 b. best practices for the treatment and care for patients who are 15 individuals with intellectual and developmental disabilities and chronic 16 illness, including but not limited to autism spectrum disorders. 17 4. The department in conjunction with the department of health shall 18 periodically evaluate such training program for relevance and practical- 19 ity. 20 5. The department shall prepare, publish and disseminate a list of 21 available training programs pursuant to this section; provided, however, 22 that the list shall be updated annually. The list shall be published in 23 a location that is accessible to persons required to attend such train- 24 ing program. Beginning one year after the effective date of this section, all 2 physicians licensed under this article shall complete six hours of 3 training biennially. 4 § 2. Mandatory training on the treatment of those with intellec- 7 tual and developmental disabilities and chronic illness. 1. Such training program shall include, but not be limited to, the 15 following: 16 a. didactic classroom instruction, experiential learning, and online 17 learning, totaling not less than six hours; and 18 b. best practices for the treatment and care for patients who are 19 individuals with intellectual and developmental disabilities and chronic 20 illness, including but not limited to autism spectrum disorders. 21 4. The department in conjunction with the department of health shall 22 periodically evaluate such training program for relevance and practical- 23 ity. 24 5. The department shall prepare, publish and disseminate a list of 25 available training programs pursuant to this section; provided, however, 26 that the list shall be updated annually. Beginning one year after the effective date of this section, all 30 physician assistants licensed under this article shall complete six 31 hours of training biennially. 32 § 3. The education law is amended by adding a new section 6554-b to 33 read as follows: 34 § 6554-b. Mandatory training on the treatment of those with intellec- 35 tual and developmental disabilities and chronic illness. 1. All chiro- 36 practors, in order to maintain his or her license in good standing, 37 shall complete a biennial training program on the treatment of those 38 with intellectual and developmental disabilities and chronic illness. 39 2. Such training program shall be developed and administered by the 40 department in conjunction with the department of health. 41 3. Such training program shall include, but not be limited to, the 42 following: 43 a. didactic classroom instruction, experiential learning, and online 44 learning, totaling not less than six hours; and 45 b. best practices for the treatment and care for patients who are 46 individuals with intellectual and developmental disabilities and chronic 47 illness, including but not limited to autism spectrum disorders. 48 4. The department in conjunction with the department of health shall 49 periodically evaluate such training program for relevance and practical- 50 ity. 51 5. The department shall prepare, publish and disseminate a list of 52 available training programs pursuant to this section; provided, however, 53 that the list shall be updated annually. All 8 dentists, in order to maintain his or her license in good standing, 9 shall complete a biennial training program on the treatment of those 10 with intellectual and developmental disabilities and chronic illness. 11 2. Such training program shall be developed and administered by the 12 department in conjunction with the department of health. 13 3. Such training program shall include, but not be limited to, the 14 following: 15 a. didactic classroom instruction, experiential learning, and online 16 learning, totaling not less than six hours; and 17 b. best practices for the treatment and care for patients who are 18 individuals with intellectual and developmental disabilities and chronic 19 illness, including but not limited to autism spectrum disorders. 20 4. The department in conjunction with the department of health shall 21 periodically evaluate such training program for relevance and practical- 22 ity. 23 5. All dental 35 assistants, in order to maintain his or her certification in good stand- 36 ing, shall complete a biennial training program on the treatment of 37 those with intellectual and developmental disabilities and chronic 38 illness. 39 2. Such training program shall be developed and administered by the 40 department in conjunction with the department of health. 41 3. Such training program shall include, but not be limited to, the 42 following: 43 a. didactic classroom instruction, experiential learning, and online 44 learning, totaling not less than six hours; and 45 b. best practices for the treatment and care for patients who are 46 individuals with intellectual and developmental disabilities and chronic 47 illness, including but not limited to autism spectrum disorders. 48 4. Mandatory training on the treatment of those with intellec- 35 tual and developmental disabilities and chronic illness. 1. All regis- 36 tered professional nurses, licensed practical nurses, nurse practition- 37 ers and clinical nurse specialists, in order to maintain his or her 38 license or certificate in good standing, shall complete a biennial 39 training program on the treatment of those with intellectual and devel- 40 opmental disabilities and chronic illness. 41 2. Such training program shall be developed and administered by the 42 department in conjunction with the department of health. 43 3. Such training program shall include, but not be limited to, the 44 following: 45 a. didactic classroom instruction, experiential learning, and online 46 learning, totaling not less than six hours; and 47 b. best practices for the treatment and care for patients who are 48 individuals with intellectual and developmental disabilities and chronic 49 illness, including but not limited to autism spectrum disorders. 50 4. The department in conjunction with the department of health shall 51 periodically evaluate such training program for relevance and practical- 52 ity. 53 5. The department shall prepare, publish and disseminate a list of 54 available training programs pursuant to this section; provided, however, 55 that the list shall be updated annually. The list shall be published inA. 9554 6 1 a location that is accessible to persons required to attend such train- 2 ing program. 3 6. Beginning one year after the effective date of this section, all 4 registered professional nurses, licensed practical nurses, nurse practi- 5 tioners and clinical nurse specialists licensed or certified under this 6 article shall complete six hours of training biennially. 7 § 10. The education law is amended by adding a new section 7004-a to 8 read as follows: 9 § 7004-a. Mandatory training on the treatment of those with intellec- 10 tual and developmental disabilities and chronic illness. 1. All podia- 11 trists, in order to maintain his or her license in good standing, shall 12 complete a biennial training program on the treatment of those with 13 intellectual and developmental disabilities and chronic illness. 14 2. Such training program shall be developed and administered by the 15 department in conjunction with the department of health. 16 3. Such training program shall include, but not be limited to, the 17 following: 18 a. didactic classroom instruction, experiential learning, and online 19 learning, totaling not less than six hours; and 20 b. best practices for the treatment and care for patients who are 21 individuals with intellectual and developmental disabilities and chronic 22 illness, including but not limited to autism spectrum disorders. 23 4. The department in conjunction with the department of health shall 24 periodically evaluate such training program for relevance and practical- 25 ity. 26 5. Mandatory training on the treatment of those with intellec- 37 tual and developmental disabilities and chronic illness. 1. All optome- 38 trists, in order to maintain his or her license in good standing, shall 39 complete a biennial training program on the treatment of those with 40 intellectual and developmental disabilities and chronic illness. 41 2. Such training program shall be developed and administered by the 42 department in conjunction with the department of health. 43 3. Such training program shall include, but not be limited to, the 44 following: 45 a. didactic classroom instruction, experiential learning, and online 46 learning, totaling not less than six hours; and 47 b. best practices for the treatment and care for patients who are 48 individuals with intellectual and developmental disabilities and chronic 49 illness, including but not limited to autism spectrum disorders. 50 4. The department in conjunction with the department of health shall 51 periodically evaluate such training program for relevance and practical- 52 ity. 53 5. The department shall prepare, publish and disseminate a list of 54 available training programs pursuant to this section; provided, however, 55 that the list shall be updated annually. Beginning one year after the effective date of this section, all 4 optometrists licensed under this article shall complete six hours of 5 training biennially. 6 § 12. The education law is amended by adding a new section 7603-a to 7 read as follows: 8 § 7603-a. Mandatory training on the treatment of those with intellec- 9 tual and developmental disabilities and chronic illness. 1. All psychol- 10 ogists, in order to maintain his or her license in good standing, shall 11 complete a biennial training program on the treatment of those with 12 intellectual and developmental disabilities and chronic illness. 13 2. Such training program shall be developed and administered by the 14 department in conjunction with the department of health. 15 3. Such training program shall include, but not be limited to, the 16 following: 17 a. didactic classroom instruction, experiential learning, and online 18 learning, totaling not less than six hours; and 19 b. best practices for the treatment and care for patients who are 20 individuals with intellectual and developmental disabilities and chronic 21 illness, including but not limited to autism spectrum disorders. 22 4. The department in conjunction with the department of health shall 23 periodically evaluate such training program for relevance and practical- 24 ity. 25 5. The department shall prepare, publish and disseminate a list of 26 available training programs pursuant to this section; provided, however, 27 that the list shall be updated annually. The education law is amended by adding a new section 7704-a to 34 read as follows: 35 § 7704-a. Mandatory training on the treatment of those with intellec- 36 tual and developmental disabilities and chronic illness. 1. All licensed 37 master social workers and licensed clinical social workers, in order to 38 maintain his or her license in good standing, shall complete a biennial 39 training program on the treatment of those with intellectual and devel- 40 opmental disabilities and chronic illness. 41 2. Such training program shall be developed and administered by the 42 department in conjunction with the department of health. 43 3. Such training program shall include, but not be limited to, the 44 following: 45 a. didactic classroom instruction, experiential learning, and online 46 learning, totaling not less than six hours; and 47 b. best practices for the treatment and care for patients who are 48 individuals with intellectual and developmental disabilities and chronic 49 illness, including but not limited to autism spectrum disorders. 50 4. The department in conjunction with the department of health shall 51 periodically evaluate such training program for relevance and practical- 52 ity. 53 5. The department shall prepare, publish and disseminate a list of 54 available training programs pursuant to this section; provided, however, 55 that the list shall be updated annually. Beginning one year after the effective date of this section, all 4 licensed master social workers and licensed clinical social workers 5 licensed under this article shall complete six hours of training bienni- 6 ally. 7 § 14. The education law is amended by adding a new section 7904-b to 8 read as follows: 9 § 7904-b. Mandatory training on the treatment of those with intellec- 10 tual and developmental disabilities and chronic illness. 1. All occupa- 11 tional therapists and occupational therapy assistants, in order to main- 12 tain his or her license in good standing, shall complete a biennial 13 training program on the treatment of those with intellectual and devel- 14 opmental disabilities and chronic illness. 15 2. Such training program shall be developed and administered by the 16 department in conjunction with the department of health. 17 3. Such training program shall include, but not be limited to, the 18 following: 19 a. didactic classroom instruction, experiential learning, and online 20 learning, totaling not less than six hours; and 21 b. best practices for the treatment and care for patients who are 22 individuals with intellectual and developmental disabilities and chronic 23 illness, including but not limited to autism spectrum disorders. 24 4. The department in conjunction with the department of health shall 25 periodically evaluate such training program for relevance and practical- 26 ity. 27 5. The department shall prepare, publish and disseminate a list of 28 available training programs pursuant to this section; provided, however, 29 that the list shall be updated annually. The list shall be published in 30 a location that is accessible to persons required to attend such train- 31 ing program. 32 6. Beginning one year after the effective date of this section, all 33 occupational therapists and occupational therapy assistants licensed 34 under this article shall complete six hours of training biennially. 35 § 15. The education law is amended by adding a new section 8004-a to 36 read as follows: 37 § 8004-a. Mandatory training on the treatment of those with intellec- 38 tual and developmental disabilities and chronic illness. 1. All dieti- 39 tians and nutritionists, in order to maintain his or her certification 40 in good standing, shall complete a biennial training program on the 41 treatment of those with intellectual and developmental disabilities and 42 chronic illness. 43 2. Such training program shall be developed and administered by the 44 department in conjunction with the department of health. 45 3. Such training program shall include, but not be limited to, the 46 following: 47 a. didactic classroom instruction, experiential learning, and online 48 learning, totaling not less than six hours; and 49 b. best practices for the treatment and care for patients who are 50 individuals with intellectual and developmental disabilities and chronic 51 illness, including but not limited to autism spectrum disorders. 52 4. The department in conjunction with the department of health shall 53 periodically evaluate such training program for relevance and practical- 54 ity. 55 5. The education law is amended by adding a new section 8206-b to 8 read as follows: 9 § 8206-b. Mandatory training on the treatment of those with intellec- 10 tual and developmental disabilities and chronic illness. 1. All speech- 11 language pathologists and audiologists, in order to maintain his or her 12 license in good standing, shall complete a biennial training program on 13 the treatment of those with intellectual and developmental disabilities 14 and chronic illness. 15 2. Such training program shall be developed and administered by the 16 department in conjunction with the department of health. 17 3. Such training program shall include, but not be limited to, the 18 following: 19 a. didactic classroom instruction, experiential learning, and online 20 learning, totaling not less than six hours; and 21 b. best practices for the treatment and care for patients who are 22 individuals with intellectual and developmental disabilities and chronic 23 illness, including but not limited to autism spectrum disorders. 24 4. The department in conjunction with the department of health shall 25 periodically evaluate such training program for relevance and practical- 26 ity. 27 5. The department shall prepare, publish and disseminate a list of 28 available training programs pursuant to this section; provided, however, 29 that the list shall be updated annually. The list shall be published in 30 a location that is accessible to persons required to attend such train- 31 ing program. 32 6. Beginning one year after the effective date of this section, all 33 speech-language pathologists and audiologists licensed under this arti- 34 cle shall complete six hours of training biennially. 35 § 17. The education law is amended by adding a new section 8413 to 36 read as follows: 37 § 8413. Mandatory training on the treatment of those with intellectual 38 and developmental disabilities and chronic illness. 1. All mental health 39 counselors, marriage and family therapists, psychoanalysts, and creative 40 arts therapists, in order to maintain his or her license in good stand- 41 ing, shall complete a biennial training program on the treatment of 42 those with intellectual and developmental disabilities and chronic 43 illness. 44 2. Such training program shall be developed and administered by the 45 department in conjunction with the department of health. 46 3. Such training program shall include, but not be limited to, the 47 following: 48 a. didactic classroom instruction, experiential learning, and online 49 learning, totaling not less than six hours; and 50 b. best practices for the treatment and care for patients who are 51 individuals with intellectual and developmental disabilities and chronic 52 illness, including but not limited to autism spectrum disorders. 53 4. The department in conjunction with the department of health shall 54 periodically evaluate such training program for relevance and practical- 55 ity.A. 9554 10 1 5. The education law is amended by adding a new section 8504-b to 11 read as follows: 12 § 8504-b. Mandatory training on the treatment of those with intellec- 13 tual and developmental disabilities and chronic illness. 1. All respir- 14 atory therapists and respiratory therapy technicians, in order to main- 15 tain his or her license in good standing, shall complete a biennial 16 training program on the treatment of those with intellectual and devel- 17 opmental disabilities and chronic illness. 18 2. Such training program shall be developed and administered by the 19 department in conjunction with the department of health. 20 3. Such training program shall include, but not be limited to, the 21 following: 22 a. didactic classroom instruction, experiential learning, and online 23 learning, totaling not less than six hours; and 24 b. best practices for the treatment and care for patients who are 25 individuals with intellectual and developmental disabilities and chronic 26 illness, including but not limited to autism spectrum disorders. 27 4. The department in conjunction with the department of health shall 28 periodically evaluate such training program for relevance and practical- 29 ity. 30 5. The education law is amended by adding a new section 8804-a to 39 read as follows: 40 § 8804-a. Mandatory training on the treatment of those with intellec- 41 tual and developmental disabilities and chronic illness. 1. All licensed 42 behavior analysts or certified behavior analyst assistants, in order to 43 maintain his or her license or certification in good standing, shall 44 complete a biennial training program on the treatment of those with 45 intellectual and developmental disabilities and chronic illness. 46 2. Such training program shall be developed and administered by the 47 department in conjunction with the department of health. 48 3. Such training program shall include, but not be limited to, the 49 following: 50 a. didactic classroom instruction, experiential learning, and online 51 learning, totaling not less than six hours; and 52 b. best practices for the treatment and care for patients who are 53 individuals with intellectual and developmental disabilities and chronic 54 illness, including but not limited to autism spectrum disorders.A. 9554 11 1 4. The department in conjunction with the department of health shall 2 periodically evaluate such training program for relevance and practical- 3 ity. 4 5. The department shall prepare, publish and disseminate a list of 5 available training programs pursuant to this section; provided, however, 6 that the list shall be updated annually. The list shall be published in 7 a location that is accessible to persons required to attend such train- 8 ing program. 9 6. Beginning one year after the effective date of this section, all 10 licensed behavior analysts or certified behavior analyst assistants 11 licensed or certified under this article shall complete six hours of 12 training biennially. 13 § 20. This act shall take effect one year after it shall have become a 14 law. Effective immediately, the addition, amendment and/or repeal of any 15 rule or regulation necessary for the implementation of this act on its 16 effective date are authorized to be made and completed on or before such 17 effective date.
