ORTIZ -- read once and referred to the Committee on Housing -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public housing law, in relation to imposing require- ments on receipt of state funding by certain housing projects in a city with a population of one million or more The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public housing law is amended by adding a new section 2 77 to read as follows: 3 § 77. Conditions precedent to certain state funding. 1. Notwithstand- 4 ing any provision of law to the contrary, no project for new 5 construction, reconstruction or rehabilitation of housing located in a 6 city with a population of one million or more shall be eligible for any 7 source of state funding, including but not limited to, loans, subsidies 8 or tax incentives unless the commissioner finds that a minimum of thir- 9 ty-two percent of the dwelling units in such project are designated for 10 low income housing. A number of such designated dwelling units equaling 11 two percent of the total dwelling units in such project shall be offered 12 to the construction workers who worked on the project through a lottery. 13 2. Such findings shall be conclusive evidence of the facts therein 14 contained except upon proof of fraud or willful misfeasance by the 15 commissioner. 16 § 2.
