          tee on Transportation

        AN ACT to amend the vehicle and traffic law, in  relation  to  extending
          the  validity  of  drivers' licenses that expire between April 1, 2020
          and July 1, 2020; and providing for the repeal of such provisions upon
          expiration thereof

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.    Subdivision 6 of section 502 of the vehicle and traffic
     2  law, as added by chapter 780 of the  laws  of  1972,  paragraph  (a)  as
     3  amended  by  chapter 37 of the laws of 2019 and paragraph (b) as amended
     4  by chapter 173 of the laws of 1990, is amended to read as follows:
     5    6. Renewal of license.  (a) A license issued pursuant  to  subdivision
     6  five  of this section shall be valid until the expiration date contained
     7  thereon, unless such license is  suspended,  revoked  or  cancelled,  or
     8  unless  the  validity of such license is extended under paragraph (c) of
     9  this subdivision. Such license may be renewed by submission of an appli-
    10  cation for renewal, the fee prescribed by law, proofs of  prior  licens-
    11  ing,  fitness  and acceptable vision prescribed by the commissioner, the
    12  applicant's social security number or, in lieu thereof, with respect  to
    13  an application for a non-commercial driver's license or learner's permit
    14  which  does  not meet federal standards for identification, an affidavit
    15  signed by such applicant that they have not been issued a social securi-
    16  ty number, and if required by the commissioner, a  photo  image  of  the
    17  applicant  in such numbers and form as the commissioner shall prescribe.
    18  In addition, an applicant for renewal of a license containing a  hazard-
    19  ous  material  endorsement  shall  pass  an  examination  to retain such
    20  endorsement. The commissioner shall, with respect to the  renewal  of  a
    21  hazardous  materials  endorsement,  comply with the requirements imposed
    22  upon states by sections 383.141 and 1572.13 of title 49 of the  code  of
    23  federal  regulations.  A  renewal of such license shall be issued by the
    24  commissioner upon approval of such  application,  except  that  no  such
    25  license  shall  be issued if its issuance would be inconsistent with the
    26  provisions of section five hundred sixteen of  this  title,  and  except

     1  that  the commissioner may refuse to renew such license if the applicant
     2  is the holder of a currently valid or renewable license to drive  issued
     3  by another state or foreign country unless the applicant surrenders such
     4  license.
     5    (b)  Time  for  renewal.  A  renewal  license may only be issued if an
     6  application for such license is filed within two years from the date  of
     7  expiration  of the prior license. Such application may be filed prior to
     8  the expiration of the license being renewed for  a  period  of  time  as
     9  provided by regulation of the commissioner.
    10    (c)  Notwithstanding  any  other  provision of this section, a license
    11  issued pursuant to subdivision five of this  section  that  contains  an
    12  expiration  date  between  and  including  the dates of April first, two
    13  thousand twenty and July first, two thousand twenty, shall be valid  for
    14  an  additional three months beyond the expiration date contained on such
    15  license.  A licensee renewing a license pursuant to this paragraph shall
    16  not be subject to a  fine  under  subdivision  eleven  of  section  five
    17  hundred nine of this article, despite such renewal being after the expi-
    18  ration date contained on such license.
    19    §  2.  This act shall take effect immediately and shall expire October
    20  2, 2020 when upon such date the provisions of this act shall  be  deemed
    21  repealed.
