        AN ACT creating the radon task force; and providing for  the  repeal  of
          such provisions upon expiration thereof
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1.  Legislative intent. The legislature recognizes the dangers
     2  to human health which exposure to radon causes.  Radon  is  a  naturally
     3  occurring, odorless radioactive gas that is one of the leading causes of
     4  lung cancer. The New York state department of health has identified over
     5  twenty-five  counties as "high risk counties" for exposure to radon.  It
     6  is critically important for New York state to  develop  a  comprehensive
     7  approach  to  protecting  New  York residents from this potential health
     8  hazard.
     9    § 2. There is hereby created the  "radon  task  force"  to  conduct  a
    10  comprehensive  study  on  the  prevention of human exposure to radon and
    11  make recommendations to reduce and minimize exposure to New  York  state
    12  residents. The scope of such study shall include:
    13    1.  Examine  the need for interagency coordination of public education
    14  and outreach and prevention programs;
    15    2. Examine the need for training, education and possible licensing  of
    16  radon services providers; and
    17    3.  Review  of  any other related information that the commissioner of
    18  health may deem necessary or relevant in carrying out such study.
    19    § 3. 1. The task force shall consist of seven members as follows:
    20    a. the secretary of state or the secretary's designee;
    21    b. the commissioner of health or such commissioner's designee;
    22    c. the commissioner of labor or such commissioner's designee;
    23    d. two members to be appointed by the governor, one of whom  shall  be
    24  an  individual who possesses expertise in the field of radon testing and
    25  mitigation and the other being an individual who represents the field of
    26  real estate;

     1    e. one member to be  appointed  by  the  temporary  president  of  the
     2  senate; and
     3    f. one member to be appointed by the speaker of the assembly.
     4    2. The governor shall designate one member to serve as the chairperson
     5  of the task force.
     6    § 4. Members of the task force shall receive no compensation but shall
     7  be reimbursed for their actual and necessary expenses in the performance
     8  of their duties pursuant to this act.
     9    §  5.  A  report of the findings and recommendations of the task force
    10  and any proposed legislation necessary to implement such findings  shall
    11  be  filed  with the governor, the temporary president of the senate, the
    12  speaker of the assembly, the minority leader  of  the  senate,  and  the
    13  minority  leader  of the assembly on or before April first, two thousand
    14  nineteen.
    15    § 6. This act shall take effect immediately and shall  expire  and  be
    16  deemed repealed May 1, 2019.
