Bill Title: Authorizes the county of Nassau to discontinue use of certain lands as parkland located in the county's Bay Park to be used for a force main from the city of Long Beach to the Bay Park sewage treatment plant and to authorize the city of Long Beach to convey to the county of Nassau an easement through land located in the city's Veteran's Memorial Park to be used for a force main from the City of Long Beach to the Bay Park sewage treatment plant.

STATE OF NEW YORK ________________________________________________________________________ 10776 IN ASSEMBLY July 9, 2020 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Thiele) -- read once and referred to the Committee on Local Governments AN ACT to authorize the county of Nassau to discontinue use of certain lands as parkland located in the county's Bay Park and to authorize the city of Long Beach to convey to the county of Nassau an easement through land located in the city's Veteran's Memorial Park The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The county of Nassau, acting by and through its county 2 legislature, is hereby authorized to discontinue use of certain park- 3 lands as parklands in Bay Park described in section five of this act, 4 for the purpose of constructing, installing, operating and maintaining a 5 force main from the city of Long Beach to the Bay Park sewage treatment 6 plant. Upon completion of the force main related construction, the coun- 7 ty of Nassau shall restore the surface of the lands more particularly 8 described in section five of this act and the lands shall continue to be 9 used for park purposes. 10 § 2. The city of Long Beach, acting by and through its city council, 11 is hereby authorized to convey by appropriate instrument to the county 12 of Nassau, an easement in Veteran's Memorial Park described in section 13 six of this act, for the purpose of enabling the county to construct, 14 install, operate and maintain a sewage force main from the city of Long 15 Beach to the Bay Park sewage treatment plant. Upon completion of the 16 force main related construction, the county of Nassau shall restore the 17 surface of the lands more particularly described in section six of this 18 act and the lands shall continue to be used for park purposes. 19 § 3. The authorization provided in section one of this act shall be 20 effective only upon the condition that the county of Nassau will perform 21 capital improvements to Bay Park in an amount equal to or greater than 22 the fair market value of the parklands being alienated pursuant to 23 section one of this act. 24 § 4. The authorization provided in section two of this act shall be 25 effective only upon the condition that the city of Long Beach will 26 perform capital improvements to Veteran's Memorial Park in an amount EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The alienation and conveyance of the parklands authorized by the 36 provisions of this act shall not occur until the county of Nassau, has 37 complied with any federal requirements pertaining to the alienation or 38 conversion of parklands, including satisfying the Secretary of the Inte- 39 rior that the alienation or conversion complies with all conditions 40 which the Secretary of the Interior deems necessary. 41 § 8. This act shall take effect immediately.
