          read once and referred to the Committee on Environmental Conservation

        AN ACT authorizing the closure of the Dunn Mine and C&D Debris  Disposal
          Facility;  and providing for the repeal of such provision upon expira-
          tion thereof

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. Notwithstanding any provision of the environmental conser-
     2  vation law or any other provision of law to the contrary, the department
     3  of environmental conservation shall, on or before July 1, 2023 close the
     4  Dunn Mine and C&D Debris Disposal Facility, provided, that prior to such
     5  closure, the city of Rensselaer shall establish other facilities  and/or
     6  utilize  other  existing  facilities to be operated as local solid waste
     7  management facilities for the city of Rensselaer.
     8    § 2. This act shall take effect immediately and shall expire  December
     9  31,  2023 when upon such date the provisions of this act shall be deemed
    10  repealed.
