STATE OF NEW YORK ________________________________________________________________________ 10880 IN ASSEMBLY July 24, 2020 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Frontus) -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, the executive law and the public health law, in relation to requiring licensed mental health counse- lors, psychologists, other certified or licensed counseling profes- sionals and emergency services personnel to complete training in suicide risk assessment and intervention The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 7603 of the education law is amended by adding a 2 new subdivision 4-a to read as follows: 3 (4-a) Training: have completed a minimum of six hours of coursework or 4 applied experience under supervision in suicide risk assessment and 5 intervention and a minimum of three hours of continuing education relat- 6 ing to suicide risk assessment and intervention; 7 § 2. Subdivision 1 of section 7704 of the education law is amended by 8 adding a new paragraph (d-1) to read as follows: 9 (d-1) Training: have completed a minimum of six hours of coursework or 10 applied experience under supervision in suicide risk assessment and 11 intervention and a minimum of three hours of continuing education relat- 12 ing to suicide risk assessment and intervention; 13 § 3. Subdivision 2 of section 7704 of the education law is amended by 14 adding a new paragraph (d-1) to read as follows: 15 (d-1) Training: have completed a minimum of six hours of coursework or 16 applied experience under supervision in suicide risk assessment and 17 intervention and a minimum of three hours of continuing education relat- 18 ing to suicide risk assessment and intervention; 19 § 4. Paragraphs (h) and (i) of subdivision 2 of section 158 of the 20 executive law, as amended by section 28 of part B of chapter 56 of the 21 laws of 2010, are amended and a new paragraph (j) is added to read as 22 follows: 23 (h) Exemptions from particular provisions of this article in the case 24 of any county, city, town, village or fire district, if in the opinion 25 of the state fire administrator the standards of fire training estab- EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD16616-02-0A. 10880 2 1 lished and maintained by such county, city, town, village or fire 2 district are equal to or higher than those established pursuant to this 3 article; or revocation in whole or in part of such exemption, if in his 4 or her opinion the standards of fire training established and maintained 5 by such county, city, town, village or fire district are lower than 6 those established pursuant to this article; [and] 7 (i) Education, health and physical fitness requirements for eligibil- 8 ity of persons for provisional or permanent appointment in the compet- 9 itive class of the civil service as fire fighters as it deems necessary 10 and proper for the efficient performance of such duties; and 11 (j) The requirements for having completed a minimum of six hours of 12 coursework or applied experience under supervision in suicide risk 13 assessment and intervention and a minimum of three hours of continuing 14 education relating to suicide risk assessment and intervention. 15 § 5. Subdivision 1 of section 840 of the executive law is amended by 16 adding a new paragraph (f-1) to read as follows: 17 (f-1) The requirements for having completed a minimum of six hours of 18 coursework or applied experience under supervision in suicide risk 19 assessment and intervention and a minimum of three hours of continuing 20 education relating to suicide risk assessment and intervention; 21 § 6. Section 3052 of the public health law is amended by adding a new 22 subdivision 6 to read as follows: 23 6. The department is authorized, either directly or through contractu- 24 al arrangement, to develop requirements for a minimum of six hours of 25 coursework or applied experience under supervision in suicide risk 26 assessment and intervention and a minimum of three hours of continuing 27 education relating to suicide risk assessment and intervention. 28 § 7. This act shall take effect January 1, 2021.
