          and Commissions

        AN  ACT  to  amend  the  public  service law, in relation to providing a
          discount to consumers of certain  utilities  for  failure  to  provide
          contracted services

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The public service law is amended by adding a  new  section
     2  119-d to read as follows:
     3    §  119-d. Failure to provide contracted services. A consumer who has a
     4  contract for service with a gas corporation, electric  corporation,  gas
     5  and  electric  corporation,  water corporation, steam corporation, tele-
     6  graph corporation,  telephone  corporation,  cable  television  company,
     7  internet service provider or a municipality rendering equivalent utility
     8  services  shall be entitled to a discount when the service such consumer
     9  has contracted for is not provided for by such gas corporation, electric
    10  corporation, gas and  electric  corporation,  water  corporation,  steam
    11  corporation,  telegraph  corporation, telephone corporation, cable tele-
    12  vision company, internet service provider or  a  municipality  rendering
    13  equivalent  utility services for a period of at least twenty-four hours.
    14  Such discount shall be applied to the monthly charges assessed  by  such
    15  gas  corporation,  electric  corporation,  gas and electric corporation,
    16  water corporation, steam corporation, telegraph  corporation,  telephone
    17  corporation,  cable  television  company, internet service provider or a
    18  municipality rendering equivalent  utility  services  by  reducing  such
    19  monthly  charges  by a percentage that is equal to the number of days of
    20  the billing cycle divided by the number of days such contracted  service
    21  was not provided to the consumer.
    22    § 2. This act shall take effect immediately.
