STATE OF NEW YORK ________________________________________________________________________ 515 2019-2020 Regular Sessions IN SENATE (Prefiled) January 9, 2019 ___________ Introduced by Sen. CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to the implementation of an electronic death registration system The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivisions 1 and 5 of section 4148 of the public health 2 law, as added by chapter 352 of the laws of 2013, are amended to read as 3 follows: 4 1. The department is hereby authorized and directed to design, imple- 5 ment and maintain an electronic death registration system for collect- 6 ing, storing, recording, transmitting, amending, correcting and authen- 7 ticating information, as necessary and appropriate to complete a death 8 registration, and to generate such documents as determined by the 9 department in relation to a death occurring in this state. As part of 10 the design and implementation of the system established by this section, 11 the department shall consult with all persons authorized to use such 12 system to the extent practicable and feasible. The payment referenced in 13 subdivision five of this section shall be collected for each burial or 14 removal permit issued on or after the effective date of this section but 15 in no circumstance after April first, two thousand twenty from the 16 registered funeral firm represented by the licensed funeral director or 17 undertaker to whom such permit is issued, in the manner specified by the 18 department and shall be used solely for the purpose set forth in subdi- 19 vision five of this section. Except as specifically provided in this 20 section, the existing general duties of, and remuneration received by, 21 local registrars in accepting and filing certificates of death and issu- 22 ing burial and removal permits pursuant to any statute or regulation 23 shall be maintained, and not altered or abridged in any way by this 24 section. [Licensed funeral directors and undertakers] Until April first, two 2 thousand twenty, registered funeral firms shall support the establish- 3 ment and maintenance of the electronic death registration system through 4 a payment, tendered for each burial and removal permit issued to a 5 licensed funeral director or undertaker, in the amount of twenty 6 dollars, provided that such payment shall be considered a cost of opera- 7 tion and the funeral director or undertaker shall not charge any addi- 8 tional fee related to such payment for funeral or other services. No 9 payment under this section shall be required on or after April first, 10 two thousand twenty. 11 § 2. This act shall take effect immediately.
