AN ACT to amend the executive law, in relation to providing for an
increase in the rates of compensation for gold star parents
The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:
1 Section 1. Paragraph (a) of subdivision 1 of section 367 of the execu-
2 tive law, as added by chapter 399 of the laws of 2007, is amended to
3 read as follows:
4 (a) A parent, identified in 10 USC 1126 as a gold star parent, of a
5 veteran who heretofore has died or parent of a veteran dying hereafter,
6 shall upon application to the state director, be paid an annual annuity
7 out of the treasury of the state for the sum of five hundred dollars for
8 such term as such parent shall be entitled thereto under the provisions
9 of this article. [In no event shall such annual annuity payment exceed
10 one thousand dollars per veteran] The amount of any annuity payable
11 under this section shall be the same amount as the annuity payable in
12 the preceding year, increased by a percentage to be determined in
13 accordance with a formula established by the division of veteran's
14 affairs. The formula shall take into account all factors the division of
15 veteran's affairs deems necessary, including, but not limited to factors
16 such as the percentage by which benefit amounts payable under title II
17 of the Social Security Act (42 USC 401 et seq.) are increased effective
18 December first, two thousand seventeen. The term "parent" for the
19 purposes of this section includes mother, father, stepmother, stepfa-
20 ther, mother through adoption and father through adoption.
21 § 2. This act shall take effect immediately.
