        AN ACT to amend the executive law,  in  relation  to  providing  for  an
          increase in the rates of compensation for gold star parents
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Paragraph (a) of subdivision 1 of section 367 of the execu-
     2  tive law, as added by chapter 399 of the laws of  2007,  is  amended  to
     3  read as follows:
     4    (a)  A  parent,  identified in 10 USC 1126 as a gold star parent, of a
     5  veteran who heretofore has died or parent of a veteran dying  hereafter,
     6  shall  upon application to the state director, be paid an annual annuity
     7  out of the treasury of the state for the sum of five hundred dollars for
     8  such term as such parent shall be entitled thereto under the  provisions
     9  of  this  article. [In no event shall such annual annuity payment exceed
    10  one thousand dollars per veteran.] Commencing in the year  two  thousand
    11  nineteen,  the amount of any annuity payable under this section shall be
    12  the same amount as the annuity payable in  the  preceding  year  plus  a
    13  percentage  adjustment  equal to the annual percentage increase, if any,

     1  for compensation and pension benefits administered by the United  States
     2  department  of  veterans'  affairs in the previous year. Such percentage
     3  increase shall be rounded up  to  the  next  highest  one-tenth  of  one
     4  percent  and  shall  not  be  less  than  one percent nor more than four
     5  percent. The director of veterans'  affairs,  not  later  than  February
     6  first  of  each   year, shall publish by any reasonable means, including
     7  but not limited to posting on the division's website, the amount of  the
     8  annuity  as  adjusted  payable under this section. The term "parent" for
     9  the purposes of this section includes mother, father, stepmother,  step-
    10  father, mother through adoption and father through adoption.
    11    § 2. This act shall take effect immediately.
