        Introduced  by  Sen. SANDERS -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health
        AN ACT to amend the public health  law,  in  relation  to  enacting  the
          "Smoke Free Parks Act of 2019"
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. This act shall be known and may be cited as the "smoke free
     2  parks act of 2019".
     3    § 2. Section 1399-o-1 of the public health law is amended by adding  a
     4  new subdivision 3 to read as follows:
     5    3.  Smoking  shall  not  be permitted and no person shall smoke in any
     6  public park in this state. The governing body of a municipality or poli-
     7  tical subdivision which operates or maintains a public park or the state
     8  agency or other entity which operates or maintains  a  state  park  must
     9  display a sign at the entrance of such public park stating "All New York
    10  State  Parks  are  now  Smoke-Free  Parks".  Any person who violates the
    11  provisions of this subdivision shall be subject to a fine  of  not  more
    12  than five hundred dollars.
    13    §  3.  This  act shall take effect on the ninetieth day after it shall
    14  have become a law.
