        Introduced  by  Sen. LAVALLE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Codes
        AN ACT to amend the penal  law,  in  relation  to  prohibiting  physical
          contact or activity in any organization's initiating ceremony
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The first undesignated paragraph of section 120.16  of  the
     2  penal  law,  as amended by chapter 86 of the laws of 1988, is amended to
     3  read as follows:
     4    A person is guilty of hazing in the first degree when, in  the  course
     5  of  another  person's  initiation into or affiliation with any organiza-
     6  tion, he intentionally or recklessly engages in conduct, including,  but
     7  not  limited  to,  making  physical  contact  with or requiring physical
     8  activity of such other person, which creates a substantial risk of phys-
     9  ical injury to such other person or a third person  and  thereby  causes
    10  such injury.
    11    §  2.  The first undesignated paragraph of section 120.17 of the penal
    12  law, as added by chapter 86 of the laws of 1988, is amended to  read  as
    13  follows:
    14    A  person is guilty of hazing in the second degree when, in the course
    15  of another person's initiation or affiliation with any organization,  he
    16  intentionally  or  recklessly  engages  in  conduct,  including, but not
    17  limited to, making physical contact with or requiring physical  activity
    18  of such other person, which creates a substantial risk of physical inju-
    19  ry to such other person or a third person.
    20    § 3. This act shall take effect immediately.
