STATE OF NEW YORK ________________________________________________________________________ 4327 2019-2020 Regular Sessions IN SENATE March 7, 2019 ___________ Introduced by Sen. STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to assault in the third degree The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 3 of section 120.00 of the penal law is renum- 2 bered subdivision 4, and a new subdivision 3 is added to read as 3 follows: 4 3. He or she causes physical injury to an operator, driver, or passen- 5 ger on a bus, taxicab, aerial tramway, subway, or other motor vehicle, 6 used for the transportation of persons for hire, or to a school bus 7 driver, a station agent or ticket agent for the entity providing the 8 transportation, and he or she knows or reasonably should know that the 9 victim, in the case of an operator, driver, or agent, is engaged in the 10 performance of his or her duties, or is a passenger; or 11 § 2.
