         printed to be committed to the Committee on Transportation
       AN ACT to amend the vehicle and traffic law, in relation to  recognizing
         out-of-state or national defensive driver classes
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1.  Section 399-b of the vehicle and traffic law is amended by
    2  adding a new subdivision 7 to read as follows:
    3    7. "OUT-OF-STATE COURSE" OR "NATIONAL COURSE" SHALL MEAN  AN  ACCIDENT
    4  PREVENTION  COURSE  APPROVED OR ACKNOWLEDGED BY ANY STATE OTHER THAN NEW
    5  YORK STATE.
    6    S 2. Section 399-g of the vehicle and traffic law, as added by chapter
    7  290 of the laws of 1998, is amended to read as follows:
    8    S 399-g. Regulations. The commissioner shall promulgate such rules and
    9  regulations as are necessary to effectuate the provisions of this  arti-
   10  cle,  INCLUDING  RULES  AND  REGULATIONS  NECESSARY  TO  APPROVE CERTAIN
   11  OUT-OF-STATE OR NATIONAL COURSES.    In  addition  to  any  requirements
   12  expressly  authorized  by this article, such regulations may include but
   13  not be limited to requirements and standards with respect  to:  delivery
   14  agencies and instructors; classroom facilities; suspension or revocation
   15  of  approval;  appeal of suspension or revocation; course administration
   16  and advertising; monitoring of courses and instructors; and reevaluation
   17  of course effectiveness pursuant to section three hundred  ninety-nine-f
   18  of this article.
   19    S  3.  This act shall take effect immediately; provided, however, that
   20  section one of this act shall take effect on the ninetieth day after  it
   21  shall have become a law.
