       Introduced  by  Sen.  HANNON -- read twice and ordered printed, and when
         printed to be committed to the Committee on Health
       AN ACT to amend the public health law, in relation to designating Carba-
         penem-resistant Enterobacteriaceae (CRE) as a communicable disease and
         requiring general hospitals to identify and  track  the  incidence  of
         such  communicable  disease  in  accordance with the hospital acquired
         infection reporting system
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Article 21 of the public health law is amended by adding a
    2  new title 8 to read as follows:
    3                                   TITLE 8
    4                            CARBAPENEM-RESISTANT
    5                             ENTEROBACTERIACEAE
    6  SECTION 2180. DESIGNATION  AS  COMMUNICABLE  DISEASE;  GENERAL  HOSPITAL
    7                  REPORTING.
    8    S  2180. DESIGNATION AS COMMUNICABLE DISEASE; GENERAL HOSPITAL REPORT-
    9  ING.  1. THE COMMISSIONER SHALL DESIGNATE AS A COMMUNICABLE DISEASE  AND
   10  INCLUDE AS SUCH IN THE SANITARY CODE, CARBAPENEM-RESISTANT ENTEROBACTER-
   11  IACEAE  (CRE).  SUCH  DISEASE SHALL BE SUBJECT TO THE PROVISIONS OF THIS
   12  ARTICLE WHICH ARE APPLICABLE TO OTHER COMMUNICABLE DISEASES.
   13    2. EVERY GENERAL HOSPITAL SHALL IDENTIFY AND TRACK  EACH  INCIDENT  OF
   14  CARBAPENEM-RESISTANT  ENTEROBACTERIACEAE, AND SHALL, ON A MONTHLY BASIS,
   15  REPORT EACH SUCH INCIDENT TO THE DEPARTMENT. FURTHERMORE, THE DEPARTMENT
   16  SHALL INCLUDE CARBAPENEM-RESISTANT ENTEROBACTERIACEAE IN ITS REGULATIONS
   17  REQUIRING GENERAL HOSPITALS  TO  IDENTIFY,  TRACK  AND  REPORT  HOSPITAL
   18  ACQUIRED INFECTIONS PURSUANT TO SECTION TWENTY-EIGHT HUNDRED NINETEEN OF
   19  THIS CHAPTER.
   20    S 2. Subdivision 1 of section 2819 of the public health law is amended
   21  by adding a new closing paragraph to read as follows:
   22    SUCH  TERM  SHALL ALSO INCLUDE CARBAPENEM-RESISTANT ENTEROBACTERIACEAE
   23  (CRE).
   24    S 3. This act shall take effect immediately.
