STATE OF NEW YORK ________________________________________________________________________ 4776 2019-2020 Regular Sessions IN SENATE March 25, 2019 ___________ Introduced by Sen. ANTONACCI -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to requiring that the member- ship of a wage board shall include two members of the affected occupa- tion before it can exercise its powers The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 655 of the labor law, as amended 2 by chapter 55 of the laws of 1992, is amended to read as follows: 3 1. Wage board. A wage board shall be composed of not more than three 4 representatives of employers, an equal number of representatives of 5 employees and an equal number of persons selected from the general 6 public. The commissioner shall appoint the members of the board, the 7 representatives of the employers and employees to be selected [so far as8practicable] from nominations submitted by employers and employees in 9 such occupation or occupations. The wage board shall not exercise any 10 powers or take any action authorized by this article unless at least two 11 members appointed to such board are employers or employees in such occu- 12 pation or occupations. The commissioner shall designate as the chairman 13 one of the members selected from the general public. The members of the 14 board shall not receive a salary or other compensation, but shall be 15 paid actual and necessary traveling expenses while engaged in the 16 performance of their duties. 17 § 2.
