          printed to be committed to the Committee  on  Insurance  --  committee

          to said committee

        AN  ACT to amend chapter 646 of the laws of 1939 relating to incorporat-
          ing the Volunteer and Exempt Firemen's Benevolent Association of North
          Tarrytown, New York, in relation to the  purpose  and  duties  of  the
          association  and the usage of moneys received from foreign fire insur-
          ance companies by the association

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. Sections 2 and 8 of chapter 646 of the laws of 1939 relat-
     2  ing to incorporating the Volunteer and Exempt Firemen's Benevolent Asso-
     3  ciation of North Tarrytown, New York, are amended to read as follows:
     4    § 2. Purposes and duty of the association. The purposes  and  duty  of
     5  the  association  is to provide relief [to indigent and disabled firemen
     6  and their families], aid and assistance to the volunteer members of such
     7  corporation who are indigent, disabled or injured in the performance  of
     8  their  duties,  and  their families; to maintain a suitable headquarters
     9  for the members of  such  corporation;  to  promote  and  safeguard  the
    10  welfare of the volunteer members of the corporation, and their families;
    11  to  provide  for  the  health and safety of the volunteer members of the
    12  corporation; and to enhance the morale of the volunteer members  of  the
    13  corporation  by  providing  social  and  recreational activities for the
    14  volunteer members of the corporation, and the promotion of the volunteer
    15  fire service within the territory protected by the fire department.
    16    § 8. Precept of payment of  foreign  fire  insurance  companies.  Such
    17  [corporation]  association  shall  collect and there shall be paid to it
    18  all tax imposed by section [one hundred thirty-three] nine thousand  one
    19  hundred  four  of  the insurance law for fire department use and benefit
    20  upon premiums on polices of insurance covering property situated  within

     1  the  North  Tarrytown  (now known as Sleepy Hollow) fire district of the
     2  town of Mount Pleasant, Westchester County, New York, or within any duly
     3  organized territory in which the fire department of said  fire  district
     4  is  obligated  to  render fire protection[, except that said corporation
     5  shall remit such percentage of all taxes so collected or paid to it,  to
     6  the  treasurer of the firemen's association of the state of New York, as
     7  may be required by the insurance law]. The officer of  said  corporation
     8  designated by its by-laws to collect and receive the aforesaid tax shall
     9  have all the powers and be subject to all the provisions of section [one
    10  hundred  thirty-three]  nine  thousand one hundred four of the insurance
    11  law, relating to treasurers of fire departments. Such corporation  shall
    12  also  be  entitled to receive a share of the tax imposed by section [one
    13  hundred forty-nine-a] nine thousand one hundred five  of  the  insurance
    14  law,  based  upon  the business written in the territory with respect to
    15  which it is entitled to collect and receive the tax under  section  [one
    16  hundred  thirty-three]  nine  thousand one hundred four of the insurance
    17  law to be collected and used by the corporation in  the  furtherance  of
    18  its purposes as set forth in section two of this act.
    19    § 2. This act shall take effect immediately.
