Bill Title: Requires the commissioner of labor, in conjunction and in collaboration with the office for new Americans, to establish criteria for English language courses and programs which upon successful completion shall lead to the issuance of a basic or an advanced certificate of English language acquisition completion; requires such a certificate to be offered to any immigrant who successfully completes an approved course, program or level of such course or program as determined by the commissioner of labor.

          printed to be committed to the Committee on Labor
        AN ACT to amend the labor law and the  executive  law,  in  relation  to
          certificates of English language acquisition completion for immigrants
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The labor law is amended by adding a new section 44 to read
     2  as follows:
     3    § 44. Certificates of English language acquisition completion. 1.  The
     4  commissioner,  in  conjunction  and in collaboration with the office for
     5  new Americans, shall establish criteria for English language courses and
     6  programs which upon successful completion shall lead to the issuance  of
     7  a  certificate  of English language acquisition completion. Such courses
     8  and programs shall be offered to immigrants, as such term is defined  in
     9  subdivision  two  of section ninety-four-b of the executive law, and may
    10  be offered in person or via a website, application, or cell phone.
    11    2. The commissioner shall issue  a  certificate  of  English  language
    12  acquisition  completion  to  any immigrant who successfully completes an
    13  approved English language course or program as determined by the commis-
    14  sioner.
    15    3. The commissioner, in conjunction  and  in  collaboration  with  the
    16  office  for  new Americans shall design and make available the following
    17  certificates:
    18    (a) Certificates of English language acquisition completion to certify
    19  successful completion of a first or basic level English language  course
    20  or program.
    21    (b)  Advanced  certificates of English language acquisition completion
    22  to certify successful completion of an advanced level  English  language
    23  course or program.
    24    4.  Each  certificate of English language acquisition completion shall
    25  indicate that the enrollee or  participant  successfully  completed  the
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  applicable  course,  program  or  level  of such course or program. Such
     2  certificates shall bear the logos of the department and the  office  for
     3  new  Americans,  the New York state seal, and shall be signed, in person
     4  or electronically, by the commissioner and the secretary of state.
     5    §  2. Subdivision 5 of section 94-b of the executive law is amended by
     6  adding a new paragraph (o) to read as follows:
     7    (o) Assist the commissioner of  labor  in  establishing  criteria  for
     8  English  language courses and programs and carrying out the responsibil-
     9  ities set forth in section forty-four of the labor law.
    10    § 3. This act shall take effect on the one hundred twentieth day after
    11  it shall have become a law. Effective immediately, the addition,  amend-
    12  ment and/or repeal of any rule or regulation necessary for the implemen-
    13  tation  of  this act on its effective date are authorized to be made and
    14  completed on or before such effective date.
