STATE OF NEW YORK ________________________________________________________________________ 5587 2019-2020 Regular Sessions IN SENATE May 8, 2019 ___________ Introduced by Sen. SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT establishing the Safe and Healthy Homes Commission to evaluate how the administration and enforcement of the New York State Uniform Fire Prevention and Building Code can be enhanced or assisted by the State Legislature and any agency of New York State; and providing for the repeal of such provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. A commission, to be known as the Safe and Healthy Homes 2 Commission, is hereby created to evaluate how the administration and 3 enforcement of the New York State Uniform Fire Prevention and Building 4 Code, hereinafter referred to as the "Uniform Code", can be enhanced or 5 assisted by the State Legislature and any agency of New York State. 6 § 2. The commission shall be composed of ten members, appointed as 7 follows: two members shall be appointed by the governor; two members 8 shall be appointed by the speaker of the assembly; two members shall be 9 appointed by the minority leader of the assembly; two members shall be 10 appointed by the temporary president of the senate; and two members 11 shall be appointed by the minority leader of the senate. The commission 12 shall be chaired by a person chosen by a majority vote at the first 13 meeting of the commission. The vice-chairperson of the commission shall 14 be appointed by the chairperson. Vacancies in the membership of the 15 commission shall be filled in the manner provided for original appoint- 16 ments. 17 § 3. The commission shall be made up of at least one member with an 18 extensive background in the inspection of commercial and residential 19 properties pursuant to the Uniform Code, at least one member with an 20 extensive background in fire prevention and safety, at least one attor- 21 ney or retired judge with extensive experience in the adjudication of EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The members of the commission shall receive no compensation for 4 their services, but shall be allowed their actual and necessary expenses 5 incurred in the performance of their duties hereunder. To the maximum 6 extent feasible, the commission shall be entitled to request and receive 7 and shall utilize and be provided with such facilities, resources, and 8 data of any court, department, division, board, bureau, commission, or 9 agency of the state or any political subdivision thereof as it deems 10 necessary or desirable to carry out properly its powers and duties here- 11 under. 12 § 5. For the accomplishment of its purposes, the commission shall be 13 authorized and empowered to undertake any studies, inquiries, surveys or 14 analyses it may deem relevant in cooperation with or by agreement with 15 any other public or private agency. The commission shall meet and hold 16 public hearings or private meetings within or without the state, and 17 shall have all the powers of a legislative committee pursuant to the 18 legislative law. 19 § 6. The commission shall report its findings, conclusions and recom- 20 mendations to the governor and the legislature no later than one year 21 after the effective date of this act. 22 § 7. This act shall take effect immediately and shall expire and be 23 deemed repealed two years after such date.
