AN ACT to amend the education law, in relation to digital materials
The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:
1 Section 1. Subdivision 2 of section 711 of the education law, as
2 amended by section 2 of part A-1 of chapter 58 of the laws of 2011, is
3 amended to read as follows:
4 2. School library materials, for the purposes of this article shall
5 mean [both] digital materials, audio/visual materials and printed mate-
6 rials that may or may not require magnification which meet all of the
7 following criteria: (1) materials which are catalogued and processed as
8 part of the school library or media center for use by elementary and/or
9 secondary school children and teachers; (2) materials which with reason-
10 able care and use may be expected to last more than one year; and (3)
11 materials which would not be eligible for aid pursuant to sections seven
12 hundred one and seven hundred fifty-one of this title. School library
13 materials meeting these criteria may include (i) hard cover and paper-
14 back books, periodicals, that is, publications which appear at regular
15 intervals of less than one year on a continuing basis for an indefinite
16 period, documents other than books, pamphlets, musical scores, other
17 printed and published materials, [and] (ii) for school year nineteen
18 hundred eighty-six--eighty-seven and thereafter, audio/visual materials
19 including films, film strips, micro-film, sound recordings, processed
20 slides, transparencies, kinescopes, video tapes, maps, charts, globes,
21 pictorial works, including pictures and picture sets, reproductions,
22 photographs, graphic works, and any other audio/visual materials of a
23 similar nature made, and any digital materials that can be accessed by
24 computer.
25 § 2. This act shall take effect immediately.
