STATE OF NEW YORK ________________________________________________________________________ 6049 2019-2020 Regular Sessions IN SENATE May 16, 2019 ___________ Introduced by Sen. HOYLMAN -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to establishing distinctive "100 Percent Electric Vehicle" license plates The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 404-ff to read as follows: 3 § 404-ff. 1. Any person who owns or leases a car running one hundred 4 percent on electricity residing in this state shall, upon request, be 5 issued a distinctive "100 Percent Electric Vehicle" license plate of a 6 design approved by the commissioner. Application for said license plate 7 shall be filed with the form and detail as the commissioner shall 8 prescribe. 9 2. The distinctive plate authorized herein shall be issued upon proof, 10 satisfactory to the commissioner, that the applicant is an electric car 11 owner or lessee. 12 3. A distinctive plate issued pursuant to this section shall be issued 13 in the same manner as other number plates upon payment of the regular 14 registration fee prescribed by section four hundred one of this article; 15 provided, however, that an additional annual service charge of twenty- 16 five dollars shall be charged for such plates. Such additional service 17 charge shall be deposited pursuant to section four hundred four-oo of 18 this article to the credit of the department of motor vehicles distinc- 19 tive plate fund, established by section ninety-five-g of the state 20 finance law, and shall be used for the production, design, advertising 21 and marketing of distinctive number plates. 22 § 2. 1. A distinctive plate established pursuant to section 404-ff of 23 the vehicle and traffic law shall only be designed, produced and issued 24 upon the delivery to the department of motor vehicles of a surety bond 25 in the amount of six thousand dollars, which shall be executed by a EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD10876-01-9S. 6049 2 1 surety company authorized by the department of financial services to 2 transact business in this state. Provided, however, that if the commis- 3 sioner of motor vehicles shall have received prior to plate design, 4 production and issuance at least two hundred orders for such distinctive 5 plate together with the additional annual service charge applicable to 6 each such order, which shall be non-refundable, no such surety bond 7 shall be required. All service charges collected pursuant to this 8 section shall be deposited pursuant to the provisions of section 404-oo 9 of the vehicle and traffic law to the credit of the department of motor 10 vehicles distinctive plate development fund established by section 95-g 11 of the state finance law and shall be used for the design, production, 12 advertising and distribution of distinctive license plates in accordance 13 with such section 95-g. 14 2. If, upon the expiration of two years following the date upon which 15 distinctive plates in the series are first available for sale two 16 hundred or more sets of such plates are sold, a bond delivered pursuant 17 to this section shall be discontinued. If fewer than two hundred sets of 18 such plates are sold by such time, the department of motor vehicles 19 shall be entitled to recover against the bond in an amount proportionate 20 to such shortfall. 21 § 3. This act shall take effect on the one hundred eightieth day after 22 it shall have become a law; provided, however, that section two of this 23 act shall take effect immediately. Effective immediately, the addition, 24 amendment, and/or repeal of any rule or regulation necessary for the 25 implementation of this act on its effective date are authorized to be 26 made and completed on or before such effective date.
