        Introduced  by  Sen. PERSAUD -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation --  commit-
          tee  discharged, bill amended, ordered reprinted as amended and recom-
          mitted to said committee

        AN ACT to amend the transportation law, in relation to requiring certain
          for-hire vehicles to install  and  maintain  an  interior  rear-facing
          video camera

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 140 of the transportation law is amended by  adding
     2  a new subdivision 11 to read as follows:
     3    11.  a.  All  commercial motor vehicles that transport passengers for-
     4  hire with a seating capacity of six passengers  or  less  except  for  a
     5  black  car, limousine, or luxury limousine, as such terms are defined in
     6  section 19-502 of the administrative code of the city of New York, or as
     7  otherwise defined in local law, shall be required to install  and  main-
     8  tain  an  interior  rear-facing video camera. Such video camera shall be
     9  recording at all times the vehicle is being operated for the purpose  of
    10  for-hire transportation, and at minimum shall:
    11    (i)  capture  and record any operator or passenger who enters or exits
    12  the vehicle;
    13    (ii) store, at a minimum, the sixty most recent  hours  of  operation;
    14  and
    15    (iii) have the ability to transmit data or otherwise provide access to
    16  local  law  enforcement  and  the  local  regulatory authority which has
    17  licensed the motor vehicle for for-hire transportation services.
    18    b. The requirement set forth in this subdivision shall not  limit  the
    19  brand  or provider of video cameras which can be utilized to comply with
    20  this subdivision. Rather, any commercial video  camera  that  meets  the
    21  minimum  requirements of this subdivision shall be considered as comply-
    22  ing with this subdivision.

     1    c. No law or regulation shall prohibit the installation and use  of  a
     2  front-facing  camera  as  long  as the minimum requirements set forth in
     3  paragraph a of this subdivision are met. Where such video camera  system
     4  also  has a front-facing video camera, the vehicle owner's motor vehicle
     5  insurance provider must have similar access to such data.
     6    d.  The  requirement set forth in this subdivision shall supersede any
     7  local regulation of video cameras installed in commercial motor vehicles
     8  engaged in the for-hire transport of passengers.
     9    § 2. This act shall take effect on the ninetieth day  after  it  shall
    10  have become a law.
