MARTINEZ -- (at request of the Division of Human Rights) -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Government Operations AN ACT to amend the executive law, in relation to clarifying that reasonable accommodation to enable a person with a disability to use and enjoy a dwelling includes the use of an animal to alleviate the symptoms or effects of a disability The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraph 2 of paragraph (d) of subdivision 2-a of 2 section 296 of the executive law, as amended by chapter 196 of the laws 3 of 2010, is amended to read as follows: 4 (2) To refuse to make reasonable accommodations in rules, policies, 5 practices, or services, when such accommodations may be necessary to 6 afford a person with a disability equal opportunity to use and enjoy a 7 dwelling, including the use of an animal as a reasonable accommodation 8 to alleviate symptoms or effects of a disability, and including reason- 9 able modification to common use portions of the dwelling, or 10 § 2. Paragraph 2 of subdivision 18 of section 296 of the executive 11 law, as amended by chapter 196 of the laws of 2010, is amended to read 12 as follows: 13 (2) To refuse to make reasonable accommodations in rules, policies, 14 practices, or services, when such accommodations may be necessary to 15 afford said person with a disability equal opportunity to use and enjoy 16 a dwelling, including the use of an animal as a reasonable accommodation 17 to alleviate symptoms or effects of a disability, and including reason- 18 able modification to common use portions of the dwelling, or 19 § 3.
