        AN ACT to amend the public health law, in relation to requiring children
          enrolled  in  an  overnight,  children's non-regulated, summer day, or
          travelling camp to be vaccinated

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. Section 1392 of the public health law is amended by adding
     2  a new subdivision 3-a to read as follows:
     3    3-a. "Children's non-regulated camp" shall mean a property  consisting
     4  of  a  tract  of land and any tents, vehicles, buildings or other struc-
     5  tures that may be pertinent to its use, any part of which may  be  occu-
     6  pied  on  a  scheduled basis by persons under sixteen years of age under
     7  general supervision for the purpose of indoor or outdoor organized group
     8  activities, involving passive and  nonpassive  recreational  activities,
     9  which are not subject to the provisions of this article.
    10    §  2. Section 1394 of the public health law is amended by adding a new
    11  subdivision 6 to read as follows:
    12    6. Each children's overnight, children's  non-regulated,  summer  day,
    13  and travelling summer day camp shall ensure that every child enrolled at
    14  such camp has been administered an adequate dose or doses of an immuniz-
    15  ing  agent  against  poliomyelitis, mumps, measles, diphtheria, rubella,
    16  varicella, Haemophilus influenzae  type  b  (Hib),  pertussis,  tetanus,
    17  pneumococcal  disease,  and  hepatitis  B,  which  meets  the  standards
    18  approved by the United States public health service for such  biological
    19  products,  and which is approved by the department under such conditions
    20  as may be specified by the public health council.  If  any  health  care
    21  practitioner,  as  defined  in  section twenty-one hundred sixty-four of
    22  this chapter, certifies that such immunization may be detrimental  to  a

     1  child's health, the requirements of this subdivision shall be inapplica-
     2  ble until such immunization is found no longer to be detrimental to such
     3  child's  health.  The commissioner shall promulgate such rules and regu-
     4  lations as shall be necessary to implement the provisions of this subdi-
     5  vision.
     6    § 3. This act shall take effect October 1, 2019.
