KAPLAN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the vehicle and traffic law, in relation to requiring stretch limousines to be inspected once every six months for safety The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision (a) of section 301 of the vehicle and traffic 2 law, as amended by chapter 429 of the laws of 1998, is amended to read 3 as follows: 4 (a) The commissioner shall require that every motor vehicle registered 5 in this state be inspected once each year, except that any vehicle 6 commonly referred to as a "stretch limousine" shall be inspected once 7 every six months, for safety, and at least biennially for emissions as 8 provided for pursuant to paragraph two of subdivision (d) of this 9 section, and in accordance with the provisions of this article, and that 10 every motor vehicle sold or transferred for use on the public highways 11 of this state by a dealer registered under section four hundred fifteen 12 of this chapter to any person other than another such registered dealer 13 or transferred for no remuneration by such a registered dealer to any 14 person other than to a welfare to work program authorized by the New 15 York state department of labor, a private industry council, a county or 16 a social services district for the sole use of public assistance recipi- 17 ents or applicants participating in the welfare to work program to which 18 such vehicle is transferred must be inspected and bear a valid certif- 19 icate or certificates of inspection prior to delivery to the purchaser 20 or transferee. Provided, however, that nothing contained herein shall be 21 deemed to exempt any motor vehicle so transferred to a welfare to work 22 program pursuant to the provisions of this subdivision from being 23 inspected in accordance with the provisions of this section or from 24 complying with all other applicable provisions of this chapter, includ- EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. This act shall take effect on the one hundred twentieth day after 4 it shall have become a law. Effective immediately, the addition, amend- 5 ment and/or repeal of any rule or regulation necessary for the implemen- 6 tation of this act on its effective date are authorized to be made and 7 completed on or before such date.
