        Introduced  by  Sen.  STEWART-COUSINS -- read twice and ordered printed,
          and when printed to be committed to the Committee on Rules

        AN ACT to amend the alcoholic beverage control law,  in  relation  to  a
          license to sell liquor at retail for consumption on certain premises

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 7 of  section  64  of  the  alcoholic  beverage
     2  control  law  is  amended  by  adding  a new paragraph (e-11) to read as
     3  follows:
     4    (e-11) Notwithstanding the provisions of paragraph (a) of this  subdi-
     5  vision,  the  authority  may  issue  a  retail  license  for on-premises
     6  consumption for a premises which shall be  located  within  two  hundred
     7  feet  of  a  building  occupied as a church, synagogue or other place of
     8  worship, provided such premises constitute a premises for  the  sale  of
     9  food  or  beverages  at retail for consumption on the premises occupying
    10  the southernmost portion of the buildings and improvements further iden-
    11  tified as suite two hundred ten and located wholly within the boundaries
    12  of the county of Westchester, bounded and described as follows:
    13    ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND, with the buildings and
    14  improvements thereon erected, situate, lying and being in  the  City  of
    15  White Plains, County of Westchester, State of New York, more particular-
    16  ly described as follows:
    17    BEGINNING  at a point in the northerly side of Main Street as the same
    18  is now laid out and established where said northerly side of Main Street
    19  is  intersected  by  the  division  line  between  the  premises  hereby
    20  described and land now or formerly of Henry E. Hartnett said point being
    21  at the southeasterly corner of the parcel hereby described;
    22    THENCE  RUNNING  along the northerly side of Main Street as now estab-
    23  lished, South 76 degrees 38 minutes 54 seconds  West  48.24  feet  to  a
    24  monument thence on a curve to the right forming the northeasterly corner
    25  of  Main  Street  and  Church Street said curve having a radius of 26.03

         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  feet, a distance of 39.836 feet (39.84 feet per deed)  to  the  easterly
     2  side of Church Street;
     3    THENCE  RUNNING  along  the  easterly  side  of Church Street North 15
     4  degrees 40 minutes West 205.61 feet to the northwesterly corner  of  the
     5  premises  hereby described and to the southerly line of a 12 foot drive-
     6  way leading from land of Henry E. Hartnett to Church Street;
     7    THENCE RUNNING along the southerly side of  said  driveway,  North  74
     8  degrees  18  minutes  50  seconds  East  74.84 feet to the northeasterly
     9  corner of the premises hereby described and land of Henry E. Hartnett;
    10    THENCE along said land of Henry  E.  Hartnett,  South  15  degrees  15
    11  minutes  30  seconds  East  233.60  feet  to  the northerly side of Main
    12  Street, at the point or place of BEGINNING.
    13    TOGETHER with the benefits of a certain Declaration of  Easement  made
    14  by  Markbeth  Building Corp dated October 28, 1981 and November 10, 1981
    15  in Liber 7736 cp 262 as set forth therein.
    16    § 2. This act shall take effect immediately.
